Deed of Mortgage Peter Herbert to Stephen Harris 1831

This Indenture, made the twenty fifth Day of March in the year of our Lord, one Thousand eight Hundred and thirty one: Between Peter Herbert of the Borough of Wilmington in the County of NewCastle in the State of Delaware, (colored man) of the one part, and Stephen Harris of the Borough aforesaid of the other part (also colored man) Whereas The said Peter Herbert in and by one certain obligation or Writing obligatory, under his Hand and Seal bearing even date herewith stands bound unto the said Stephen Harris in the Sum of Five hundred Dollars, conditioned for the payment of Two hundred and fifty dollars on or before the twenty fifth day of March in the year of our Lord one thousand eight hundred and thirty four, with lawful interest for the same to be paid annually from the day of the above date, As in and by the said obligation and Condition thereof, relation being thereunto had, may more fully and at large appear. Now this Indenture Witnesseth  That the said Peter Herbert for and in consideration of the Aforesaid Debt or Sum of Two hundred and fifty Dollars and for the better securing the Payment thereof with its interest unto the said Stephen Harris his Executors, Administrators and assigns, in discharge of the said recited obligation and in consideration of the further sum of Fifty Cents by the said Stephen Harris to the said Peter Herbert in Hand Paid, at or before the Sealing and Delivery of these Presents the Receipt whereof is acknowledged, Hath Granted, Bargained, Sold, Released and Confirmed and By these Presents doth Grant, Bargain, Sell Release and Confirm unto the said Stephen Harris and to his Heirs and assigns all That certain Lot or piece of land and Brick messuage situate in the Borough of Wilmington aforesaid, bounded and described as follows to wit. Beginning at a stake on the east side of French Street, twenty ^five feet from the North west corner of the Widow Robinett’s Lot, thence South Fifty eight degrees ease, one hundred and ninety feet, be it more or less to John White’s line, thence with his line twenty three feet to another corner in the said White’s line, thence on a right angle, and parallel with the first line, one hundred and ninety feet more or less to French Street, thence binding on French Street twenty three feet to the place of Beginning, be the Content thereof more or less, (Being) the same land and premises which the said Stephen Harris by his Indenture bearing even date herewith, and Executed before the execution hereof for the considerations therein mentioned did grant and confirm unto the said Peter Herbert in Fee, the above mentioned Sum of Two Hundred and fifty dollars being a part of the said consideration) Together will all and singular the houses, out houses, Buildings, barns, stables, gardens, orchards, improvements, ways, woods, waters, water courses, rights, liberties, privileges, hereditaments and appurtenances whatsoever thereunto belonging, or in any wise appertaining: To have and to hold the said Messuage and Lot of land, hereditaments and Premises hereby granted or leaned, or intended so to be with the appurtenances, unto the said Stephen Harriss his Heirs and assigns, to the only proper Use and Behoof of the Said Stephen Harris his Heirs and assigns forever. Provided always nevertheless That if the said Peter Herbert his Heirs, Executors or Administrators, shall and do well and truly Pay or cause to be paid unto the said Stephen Harris his Heirs, Executors, Administrators, or assigns the aforesaid Debt or Sum of Two hundred and fifty dollars, on the day and time herein before mentioned and appointed for the payment thereof with lawful Intererst for the same according to the Condition of the said recited obligation without any fraud or further delay, and without any deduction, defalcation or abatement to be made of any thing, for or in respect to any Taxes, charges or assessments whatsoever. That then and from thenceforth, as well this present Indenture and the Estate hereby granted, as the said recited obligation shall cease, Determine, and become absolutely void, to all intents and purposes whatsoever, any thing herein before contained to the contrary in any wise notwithstanding. State of Delaware NewCastle County Ss. Be it remembered, That on this twenty fifth day of March in the year of our Lord one Thousand eight Hundred and Thirty one, Personally appeared before the subscriber one of the Judges of the Supreme Court of the State of Delaware Peter Herbert the Grantor named in the within and foregoing Indenture, and he the said Peter Herbert acknowledged the same to be his act and Deed, and desired it might be recorded as such.
