This Indenture made the twenty fifth day of March in the year of our Lord one thousand eight hundred and thirty one. Between Stephen Harris of the Borough of Wilmington in the County of New Castle in the State of Delaware (Colored man) of the one part and Peter Herbert of the same Borough (colored man) of the other part, Whereas Samuel Owens and Mary his Wife by Indenture under their hands and seals, bearing date the first day of September AD. 1804, for the consideration therein mentioned, did grant and confirm unto the said Stephen Harris, and to his heirs and assigns, a certain Lot or piece of land and Brick Messuage thereon erected situate in the Borough of Wilmington aforesaid bounded and described as follows, to wit, Beginning at a stake on the east side of French Street at the distance of twenty five feet from the north west corner of the Widow Robinett’s lot, thence south fifty eight degrees east one hundred and ninety feet be it more or less to John Whites line thence with his line twenty three feet to another corner in the said White’s line, thence on a right angle and parallel with the first line, and by a line dividing this lot from land formerly of John Hill, and afterwards of Daniel Juniper Adams’ heirs one hundred and ninety feet more or less to French street thence binding on French Street twenty three feet to the place of beginning, be the contents more or less. To hold the same to him the said Stephen Harris his heirs and assigns forever, Under and Subject to the privilege of John Hill his heirs and assigns to join the end walls of any houses or buildings built on either of the lines of this lot, with any building or buildings which he or they may choose to erect on either of the adjoining lots without paying for one half as customary, or any part thereof; as in and by the said recited Indenture recorded in the Rolls Office, at New Castle in Book D vol 3rd folio 475 &c reference being thereunto had at large appears. Now this Indenture Witnesseth that the said Stephen Harris for and in consideration of the sum of Three hundred and fifty dollars to him in hand paid by the said Peter Herbert, at and before the ensealing and delivery hereof, the receipt whereof is hereby acknowledged Hath granted, bargained sold, aliened, enfeoffed, conveyed and confirmed, and by these presents doth grant, bargain, sell, alien, enfeoff, convey and confirm unto the said Peter Herbert and to his heirs and assigns all that the above mentioned and described messuage or tenement and lot or piece of land be the same more or less. Together with all and singular the houses, buildings, ways, woods, waters, water courses, rights, liberties, privileges, hereditaments and appurtenances whatsoever thereunto belonging or in any wise appertaining, and the reversions and remainders, rents, issues and profits thereof; And also all the estate, right, title, interest, property, claim and demand whatsoever of him the said Stephen Harris in Law or equity or otherwise howsoever, of in to or out of the same. To have and to hold the said messuage or tenement and lot or piece of land hereditaments and premises hereby granted or mentioned or intended so to be with the appurtenances unto the said Peter Herbert his heirs and assigns to the only proper use and behoof of the said Peter Herbert his heirs and assigns forever. Under and subject to the aforesaid privilege reserved to the said John Hill his heirs and assigns; And it is further covenanted and agreed by and between the said parties to these presents, that he the said Stephen Harris, and his heirs, the said above mentioned and described messuage or tenement and lot of land and premises hereby granted or intended so to be with the appurtenances, (subject as aforesaid) unto the said Peter Herbert his heirs and assigns against him the said Stephen Harris and his heirs, and against all and every other person and persons whomsoever lawfully claiming or to claim by, from or under him them or any of them shall and will Warrant and for ever Defend by these presents.
