Will, Whittington Butcher 1837

To all whom it may Concern

Be it Remembered that I Whittington Butcher of the City of Wilmington and County of New Castle in the State of Delaware, Laborer, being in a Sound and Disposing mind and Memory, Blessed be God for his Mercies, yet calling to mind the Uncertainty of this Life and being desirous to settle my temporal Estate have thought Proper to make and Publish this my last Will and Testament in Writing in manner and form as herein after Mentioned. that is to Say, First of all it is my Mind and Will, that all my Just Debts and Funeral Expences shall be paid out of my estate, in a reasonable time after my Decease, by my Executrix herein after named.

Item, I give, Devise and Bequeath to my beloved Wife Rachel Butcher all my Real and Personal Estate of every kind and Nature that shall remain after the Payment of my aforesaid Debts and Funeral Expences in such manner that my said Wife shall have and Receive the benefits and Profits thereof During her Natural Life and at her Decease.

I give and Devise to my Two Nephews, George Macklin Son of my Sister Rebecka Macklin and Whittington Patton Son of Naomi Patton to them and their Heirs forever and to each Share and Share alike both Real and Personal or of what kind soever the same may be with all the Priveliges Connected with the Same. I do hereby Nominate, constitute and appoint my beloved Wife Rachel Butcher Executrix of this my last will and Testament hereby Revoking and making Void all Wills by me at any time made heretofore and Declare this my last Will and Testament.

Signed, Sealed Published and Declared by the above named Whittington Butcher to be his Act and Deed we have at his request and in his Presence and in the presence of each other set our Names as Witnesses to the same this 9th Day of April One Thousand Eight Hundred and Thirty Seven. NewCastle County Ss. Personally appeared Michael O’Brien and Joseph McClay the two subscribing Wit- nesses to the above and foregoing Instrument of writing and having been solemnly sworn upon the Holy Evangels of Almighty God, did say that they did see Whittington Butcher the Testator by way of making his mark, sign and seal the Said Instrument of writing and heard him publish, pronounce, and declare the same to be his Last Will and Testament, That at the time of his so doing he was to the best of their belief of sound, and disposing mind & memory, and that it was at the request of the Testator, in his presence and in the presence of each other, they subscribed their names thereto, as Witnesses.
