Will Francis Bailey 1823

In the name of God Amen I Francis Bailey of the Village of Newport and County of Newcastle State of Delaware being in good health and of perfect mind and memory but considering the Mortality of my body and that it is appointed once for all men to die and after that the Judgement. I do hereby make and ordain this to be my last will and Testament and do hereby make Void and of no effect all other Wills and Testaments by me in any wise heretofore made either verbally or in writing Viz. In the first place it is my will and desire that my Legal debts dues or demand be paid together with my funeral expences out of what it hath pleased God to bless me with in this present World. Secondly I Will and bequeath  Thirty Dollars unto the Union Church of Wilmington at present Occupied by Spencer and Anderson. Thirdly and lastly I Will and bequeath unto my beloved Wife Grace Bailey the Residue of my estate both Real and personal during her natural life also I leave her full power to dispose of the same as She may think fit and proper so to do after my Decease. So help me God – In Witness whereof I set my hand this 4th day of February in the year of our Lord One Thousand Eight Hundred and Nineteen. Francis Bailey {seal}

New Castle County Sst Before me personally appeared John L Morris and Aaron Justis two of the subscribing Witnesses to the above Will who being qualified according to Law did Say the said John L Morris that he did hear the Testator publish pronounce & declare the foregoing Instrument of Writing to be his last Will and Testament, & the Said Aaron Justis that he did see the Testator sign and Seal the said Instrument of writing likewise heard him publish pronounce and declare the same as and for his last Will and Testament that at the time of his So doing he was to the best of their belief of Sound and disposing mind and memory and that it was at the request of the Testator in his presence and in the presence of each other they severally subscribed their Names thereto as Witnesses. And at the same time saw Thomas W, Robeson subscribe his name as another Witness to the Same. In Testimony whereof I have hereunto set my hand at NewCastle, Oct 31. 1823. Evan M. Thomas Recr.
