Be it Remembered that I Joseph Nicholson of the Borough of Wilmington County of Newcastle and State of Delaware (Couleredman) being (though weak of body) of sound disposing mind and memory have thought proper by this my last will and Testament to dispose of my worldly affairs in manner and form following viz.

It its my mind and will that all my Just debts and funeral Expences be paid and discharged by my Executors herein After Named as also all the Legacies here after bequeathed within one year after my discease

Imprimus I give and bequeath to my loving wife Mary Nicholson her heirs and assigns for Ever the full Third part of all my personal Estate. likewise the full third part of the Rents profits & Emoluments Arising from my Real Estate for and during the time she remains my widow Item I give and bequeath to my son Martin Nicholson his heirs and assigns the sum of Fifty Cents Lawfull money of the Delaware state to be paid to him by my Excutors Afsd.

Item I give give & bequeath to my daughter Dianah Wheelbanks her heirs & assigns the sum of sixty seven Cents Lawfull money of this state to be paid by my Executors afsd

Item I give and bequeath to my Daughter Ester Newbourn[?] her heirs & assigns the full sum of sixty seven Cents lawfull money of this State to be paid by my Executors afsd

Item I give and Bequeath to my Daughter Susannah Nicholson her heirs & assigns the full sum of Sixty seven Cents Lawfull money of this state to be paid by my Executors afsd

Item I give and Bequeath to my Neice Jane Shad her heirs and assigns for Ever all the Overpluss and Remainder of my Estate both Real and personal for her or them to have and to hold for her & their proper Use and Benefit —- and further I the aforesaid Joseph Nicholson do hereby Nominate and appoint my Trusty and Loving Friend Jeremiah Shad (butcher) and Dublin West (Couleredman) Both of the Borough County and State afforesaid to be my whole and Sole Executors to this my last will and Testament with full and Ample Powers to do all and Every the thing heretofore mentioned hereby making Null and Void all other wills and Testaments heretofore by me made and Executed In witness whereof I have hereunto set my hand and Seal this Nineteenth day of April One Thousand Eight Hundred and Nine. Signed sealed publish and Declared by the within Named Joseph Nicholson to be his last will and Testament in the presence of Us who in his presene and in the presence of Each Other have hereunto subscribed our Names as Witnesses to the same Amos Jones James Simpson Isaac Solomon

Note “Fifty Cents” was written on erasure “for Martin Nicholson by direction of the Testator April 16th 1814 and witnessed at his request by William Shippy afsd Peter S Alrich

New Castle County Ss. Personally appeared Isaac Solomon one of the subscribing witnesses to the foregoing Will and William Shipley one of the subscribing Witnesses to the note, respecting the erasure and an insertion of the words “Fifty Cents” in the bequest to Martin Nicholson, and upon their solemn affirmations did severally say, the said Isaac Solomon, that he saw Joseph Nicholson the Testator, (by way of making his mark) sign and seal the foregoing Instrument of writing and the said William Shipley, (after the erasure and alteration had been made, heard him publish pronounce and declare the same to be his last Will and Testament, that at the time of his so doing, he was (to the best of their belief) of sound disposing mind and memory – that it was at the request of the Testator and in his presence they severally subscribed their names thereto as witnesses – and the said Isaac Solomon saw Amos Jones and James Simpson subscribe their names thereto as Witnesses, and the said William Shipley saw Peter S.
