Deed Andrew Hamilton & Wife Mary to Samuel Chew 1742

This Indenture made the Twenty Eight Day of February in the Sixteenth Year of the Reign of our Sovereign Lord George the Second by the Grace of God of Great Brittain France & Ireland King Defender of this faith &c Annoq Dom: 1742. Between Andrew Hamilton of the City of Philadelphia & province of Pennsylvania mercht. & Mary his Wife of the One part, & Doctr Samuel Chew of Kent County upon Delaware Esqr of the other part. Wittnesseth that the Said Andw Hamilton & Mary his wife, for & in Consideration of the Sum of Eight hundred pounds Sterlg Money of Great Brittain to the Said Andw. Hamilton in hand paid or secured to be paid by the said Samuel Chew at or before the Ensealing & Delivery of these presents, (the Rect. whereof is hereby Acknowledged) have & Either of them hath granted bargained Sold aliened Enfeoffed released & Confirmed & by these Presents do & Either of them doth grant Bargain Sell Allien Enfeoff & release & Confirm unto the said Samuel Chew his heirs & Assigns, All that messuage & plantation of him the Said Andw. Hamilton Commonly Called & Known by the Name of Whitehall Situate & being upon & Near To Duck Creek in the Said County of Kent and all that Tract or parcell of Land of the Said Andw. Hamilton Lying Contiguous to the Said Whitehall plantation & which Andw. Hamilton Deced Late Father of the Said Andw. Hamilton party hereto purchased from the Execr of Abraham Bickley Decsd: And also all other the Tracts prcls Portions & Quantities of Land Whatsoever Lying Contiguous or Near to the Said other Lands Hereditamts & premises in & to which the Said Andw. Hamilton hath any Manner or Interest property Title Claim or Demand Whatsoever (which Said Lands Hereditamts & premises were Late belonging to the Said Andw. Hamilton the father & by him in & by his Last Will & Testament Duely Executed & Remaining in the Reg Govt Office at Philadelphia were given & Devised to the said Andrew Hamilton party hereto & his heirs in fee simple as in & by the Last Will Appears) Together with all & Singular, Houses Out=houses Edifices Buildings Mines Minerals Quarries Meadows Marshes Savannahs Swamps Cripples Woods Underwoods Timber & trees Ways of Waters Water Courses Liberties Profits Commodities Advantages Hereditamts & Appurtenances Whatsoever to the Said Messuages & plantation Tracts Parcells portions & Quantities of Land, Hereditamts & premisses belonging or in any wise Appertaining & Lying Within the Bounds & Limits thereof, & the Reversions & Remainders, Rents Issues & profits thereof, And all the Estate Right title Interest & property claim & Demand Whatsoever of him the said Andrew Hamilton party hereto of if to or out of the Said Hereditamts & premises & Every or any part or parcell thereof, To have and to hold the said messuage & plantations Tract & Tracts portions & quantities of Land Hereditamts & premises hereby granted or mentioned or Intended so to be with the Appurenances unto him the said Samuel Chew his heirs & assigns To & for the property use & Behoof of the Said Saml Chew his heirs & assigns for ever. Under the yearly Quitrents & Services to the Chief Lord of the fees thereof now Due & from henceforth to Accrue & grow due for the Said premises, And this Indenture further Wittnesseth that the said Andrew Hamilton party hereto for the Consideration Afsd hath Granted Bargained & Sold & by these presents Doth grant bargain & Sell unto the said Samuel Chew & his assigns all & singular the Household & other goods Implemts of Husbandry, Stock of Negroes & Cattle Corn Grain Hay & all other the goods Chattles & things Whatsoever of him the the said Andw Hamilton party hereto which are now upon or belonging to the said Whitehall plantation Lands Hereditaments & premises hereby granted or mentioned so to be, & Every or any part & parcel thereof with their & Every of their Appurtenances To hold unto him the said Samuel Chew his Exects Admrs & Assigns as his & their own proper Goods & Chattles for ever AND the said Andw Hamilton party hereto Doth hereby for himself his heirs Execrs & Admrs Covenant promise & Grant to & with the said Samuel Chew his heirs & Assigns that he the said Andw Hamilton his heirs Exers & Admrs & all & Everyother person & persons whatsoever Lawfully Claiming or to Claim the said messuage & plantation Tract & Tracts portions & Quantities of Land Hereditaments & premises hereby granted or any part thereof by from or under him them or any of them shall & will at the request Costs & Charges of the Law of the Said Samuel Chew his heirs Exers Admrs or Assigns or any of them do Execute & perform all & Every such further & other Lawfull & Reasonable Acts Assurances & Conveyances in the Law whatsoever for the further & Etter Assuring Conveying & Confirming the Same Hereditaments & premisses with the appurtenances unto the said Samuel Chew his heirs & assigns according to the true meaning of these presents or by him the said Samuel Chew his heirs & assigns or any of them shall be Reasonably Devised Advised & Required. And the said Andw Hamilton party hereto Doth hereby authorize and Appoint Kinsey Johns & Samuel Johns Jointly or either of them severally to acknowledge & Deliver this his Deed in Open Court at the Next or any other subsequent Court of Common pleas & to be held in & for the said County of Kent in order that the same may be there proved & Recorded as the law in such case Directs. Received: the Day of the Date above from the above named Samuel Chew the Sum of Eight hundred pounds Sterling by his Bond of this Date: I Say Raised as Aforesaid Wm Till John Ross Wm Peters By me. Andrew Hamilton

Memo: the twenty Eighth day of February 1742. Before me William Till Esqr Mayor of the City of Philadelphia one of the Justices C P personally Appeared the within named Andrew Hamilton & Mary his wife & acknowledged the within written Indenture to be their Deed & as such Desired the same may be Recorded & the Said Mary being at the same time Secretly & apart Examined, Declared her full & free Consent to the Said Deed, & that she joyned with her said Husband therein without any Compulsion whatsoever: Witness my hand & seal. Kent County Sst Memo: that on the Twenty third Day of March 1742 before me Peter Galloway Esqr ^one of the Justices of the peace of this County personally appeared Wm Till Esqr, Mayor of the City of Philadelphia & Likewise one of the Justices of the peace etc & being solemnly Sworn did Declare that he saw Andw Hamilton & Mary his wife Seal & Deliver the Within de[ed] unto Samuel Chew Esqr on the Day of the Date thereof that he signed his names thereto as a Witness & that he likewise saw John Ross & Wm Peters Esqrs Subscribe their names as witnesses to the said Execution, & further that the Certificate of the private Examination[ion] of Mary Hamilton hereon Indorsed was made & Signed by him the Said Deponant Wittness my hand & Seal. Kent County Sst. Nicholas Ridgely Esqr one of his Majesties Justices of the Court of Common pleas do hereby Certifie that on the Eleventh Day of May Anno Dom: 1743 Came into the Court of Common pleas Samuel Johns & Hensey Johns & by virtue of the power within to them given did acknowledge the within Deed to Samuel Chew Esqr & that the Lands Expressed therein specified to be his Right & property according to the purport & Effect of the said Deed
