This Indenture made this Twenty eighth day of December in the year of our Lord one thousand seven hundred and Fifty nine Between Mary Alford of Kent County on Delaware Executrix of the Testament and last Will of Thomas Alford deceased of the one part, And Benjamin Chew of the City of Philadelphia Attorney at Law Witnesses That for and in Consideration of the Sum of Eighty pounds Eighteen Shillings and nine pence current money of the Lower Counties on Delaware due and justly owning to the said Benjamin from the said Thomas Alford in his Life Time And further for the fulfilling and performing the Testament and last Will of the said Thomas Alford in favor of his Grandson Thomas Welles the said Mary Alford Hath Bargained and sold and by these Presents doth Bargain and Sell to the said Benjamin Chew his Heirs Executors and Administrators the following negroes late the Estate of the said Thomas Alford, that is to say. One Negro Man named James, one negro Woman named Sil, one negro Girl named Nan, one Negro Girl named Sal, To Have and To Hold the said negroes to the said Benjamin Chew his Executors Administrators and Assign to the proper use of the said Benjamin His Exers Admrs and Assigns. And the said Mary Alford for herself her heirs Executors and Administrators shall and will Warrant & Forever defend the said Negroes and every of them to the said Benjamin His Execrs Admrs and Assigns. Provided always that the said Mary Alford her heirs Executors or Administrators shall well and truly pay to the said Benjamin Chew his Executors, Administrators or Assigns the full and just Sum of Eighty pounds Eighteen shillings and nine pence with lawful Interest for the same on the twenty eighth day of December next, then this Indenture and the Bargain and Sale hereby made to the sd Benjamin for the above Debt due to him shall be void. And then and in such Case the said Benjamin his heirs Execrs and Admrs shall have and hold the said negroes in Trust that is to say, the Use of them for the support And in maintaining of the said Mary Alford during the Term of her Natural Life, and after her decease in Trust for the aforesaid Thomas Wells his heirs and Assigns for ever. And to and for no other use whatsoever. And the said Mary Alford for herself her heirs Executors and Administrators doth Covenant and agree to pay the aforesaid Sum of Eighty pounds Eighteen Shillings and nine pence with lawful Interest on the Twenty eighth day of December next. Be it Remembered that on the Sixteenth day of December in the year of our Lord Anno Domini Seventeen hundred and Sixty came Samuel Chew one of the Subscribing witnesses to the within Deed, and made Oath on the Holy Evangelists of Almighty God that he saw Mary Alford Sign Seal and duly execute and Deliver ye within Deed as her Act and Deed for the uses therein mentioned and at the same Time saw Richard Wells Esquire Sign his name thereto as a Witness and at the same time he Subscribed his name thereto as a Witness In Testimony whereof I have hereunto affixed the Publick Seal of Kent County aforesaid.
