Henry Viney (n) Land
Edward Ridgely counsel for George Morris’ Administrater of Henry Viney (n) deceased prepared the following petition to the Court praying an order for the sale of the said deceased land for the payment of his debts viz: Administrator of all and singular the goods and chattels, rights and credits which were of Henry Viney colored man late of Duck Creek Hundred and County aforesaid, deceased, Respectfully represents, That the said Henry Viney died intestate on or about the 22d day of March A.D. 1859 being entitle viz virtue of an alienation bond or obligation from Ayers Sickley to the following described real estate to wit: A tract of land situated in Duck Creek Hundred, Kent County and State of Delaware adjoining lands of Jonathan Allee, James D. Allee & Sarah Savin, lands of Alxandr Peterson and other lands, containing about 17 acres more or less in tenure of Henry Rees (n) That the said Henry Viney left to Survive him at the time of his death two children viz: Hester wife of your petitioner, George Morris and Angelica wife of John Johnson all whom reside in this county, his only heirs at law such of whom are still living. That the said Henry Viney at the time of his death, was endebted to sundry person which in the aggregate, amounts to a large Sum of money: and that his personal estate is in a large amount insufficient for the payment of his debts, as will appear by reference to the account herewith exhibited and to which the subscriber begs here to refer, that it will be necessary to sell the above described real estate for the payment of said debts, that your petitioner has given the usual notices required by the act of Assembly in that behalf and the rules of the Court to the parties interested in the said real estate of his intention to apply on the second day of the Second Term of this Court for an order to sell the whole or such tract of the real estate of said Deceased, as will be necessary to sell [settle?] the debts due and outstanding, against the same.
Your petitioner therefor prays this Honorable Court to grant an order for the sale of said real estate, or so much thereof as may be necessary for the purpose aforesaid according to the form of the Acts of the General Assembly in such case made and Provided, And Your Petitioner will ever pray etc. George Morris his mark Administrator
March Term A.D. 1860
Now to wit this 28th day of March A.D. 1860, The Court having read and considered said petition did grant the prayer thereof and made an order authorize a sale of the real estate of the said Henry Viney (n) deceased and directed and to be taken in the sum of Two Hundred Dollars and Jonathan Allee approved as surety, proof of the Service of notice made on the affidavit of Presley Ford pled with the ????? In this cause.
And thereupon George Morris Administrator as aforesaid with Jonathan Allee surety appeared and gave kind agreeably to the directions of the Court.
