This Indenture made the Twenty fourth day of October in the year Of our Lord, one thousand, eight hundred and Seventy two, Between William Whipper of the City of New Brunswick in the State of New Jersey, Gentleman, hereinafter called the Grantor of the First Part Harriet Lucinda Whipper his wife of the Second Part, And Julia Ann Purnell of the City of Philadelphia in the State of Pennsylvania wife of James Whipper Purnell of the same City Accountant, Adelaide Amelia Wormley of the City of Washington in the District of Columbia wife of William Henry Ashburton Wormley of the same City Gentleman, And Marion Purnell Shadd of said City of Washington Spinster Residuary Devisees of Absalom William Shadd, Late of the Township of Raleigh in the County of Kent, And Province of Ontario, yeoman, now deceased herein after called the Grantees of the Third Part Whereas the said William Whipper, And the said Absalom William Shadd, were Tenants in common, of certain Lands in the Village of Dresden, in the said County of Kent, including the Lands hereinafter mentioned and described And, Whereas the said Absalom William Shadd departed this life in or about the month of June, A.D. 1857, And by his Last Will and Testament duly executed to pass real Estate, in Ontario, and bearing date the tenth day of June A.d. 18757, did after certain devises therein set forth, devise and bequeath unto Julia Ann Shadd, (now Purnell) Adelaide Amelia Shadd (now Wormley) And Marian Purnell Shadd, the residue of his real and personal Estate, including his Estate in the Lands so held in common, as aforesaid, and whereas by a certain Report And order confirming the same, issued out of the County Court of the aforesaid County of Kent, in the matter of Partition between said William Whipper, And said Grantees and one Eliza Julia Shadd, bearing date the Sixth day of July 1861, The lands hereinafter mentioned, and conveyed, were apportioned to and became vested in said Grantees, And the remainder of the Lands as held in common, as aforesaid were apportioned to and became vested in the said Grantor And Whereas Doubts have arisen respecting the said matter of Partition, And as to the regularity of the proceeding therein And the validity of the said Report And Order made And Whereas in Order to set at Rest such Doubts as aforesaid, And to confirm the Title of the said Grantees in the Lands hereinafter mentioned the said Grantees have requested the said Grantors to execute these Presents, And the said grantor in consideration of the execution by the said Grantees of a Deed of Quit Claim, of the land so apportioned to him as aforesaid has covenanted so to do,
Now this Indenture witnessed that in pursuance of the premises, and in consideration of the execution by said Grantors of the aforesaid Quit claim and of the sum of five shillings of Lawful money of Canada, now paid by the said Grantees to the said Grantor (the receipt whereof is hereby by him acknowledged, he the said Grantor Doth Grant Release and Quit Claim unto the said Grantees, their heirs and Assigns for ever, All the Estate, right, title, Interest claim and demand whatsoever both at Law And in Equity, or otherwise howsoever, And whether in possession or expectancy of him the said Grantor of, in, to or out of all and Singular Those certain parcels or tracts of Land and Premises situated lying, and being, in the said Village of Dresden, in the County of Kent, and composed of And being Lots Numbers Two and Three, in Block “B”, and fronting on Saint George Street, Lots Numbers One, two, three, four, five, Six, Seven,and Eight, in Block F, And fronting on Queen Centre, and Lindsey StreetsLots Numbers One and Three, in Block “G” fronting on St John Streets Lots One and Six in Block “I” Lot Eight in Block “K” Lot Four in Block “L” and Lots One hundred and One, One hundred And two, One hundred And three, on Medcalf Avenue, all a Laid out on part of Lot Number Four in fourth and fifth Concessions of the Township of Gore of Camden, in the County of Kent, by Richard Parr, P. L. S.
To have and to Hold the same unto the said Grantees their heirs and Assigns to and for their sole and only use Forever, Subject Nevertheless to the reservations, limitations provisions and conditions expressed in the original Grant from the Crown, And the said party of Second Part, wife of said Grantor hereby Bars her dower in said Lands, In Witness whereof said parties hereto have hereunto set their hands And Seals, sgd William Whipper {seal} in Presence of by his Attorney J.
