Will of Peter Allee 1773

In the of God Amen I Peter Allee of Duck Creek Hundred and County of Kent on Dilaware yeoman being very weak of Body but of perfect mind and Sound disposing memory calling to mind the mortality of my Body and knowing that is appointed for all men once to Die have thought proper to make this my Last will and Testament

First I recommed my Soul toe Almighty God that gave it being and my body I recommend to the Earth to be decently Buried at the Discretion of my Executors hereafter Mentioned

Item it is my will that all my just debts be paid out of my estate

Item I give and Bequeath to my Dear Brother Presley Allee all my wearing Apparel

Item I give and Bequeath to my Brothers Abraham Allee John Allee Presley Allee and to my Sister Mary Allee all my moveable Estate after my Just Debts and Legacys paid hereafter mentioned also I give unto my ^Brothers Abraham Allee John Allee Presley Allee and Mary Allee my Sister that Plantation whereon I now Live it being part of a Tract of Land known by the name Hillyards Adventure Situate in Duck Creek Hundred and County afore Said and on the North Side of Ironses Branch to be Sold and the Money to be Equally Divided amongst my three Brothers and Sister Viz Abraham Allee John Allee Presley Allee and Mary Allee and if Either of my Brothers or Sister Should Die without Issue him or her part to be Equally Divided amongst the Remaining Brothers or Sister

Item I give unto my Sister Mary Allee my Brown Riding Mare

Item I also give unto Frances Cooper my Little Mare I Call Roan. I also Give unto the said Frances Cooper the Bed and furniture I Call mine and Eleven pounds ten shillings Current Money of this Government, and also two Cows and Calves I give to the said Frances Cooper

Item My will is that my two Executors Abraham Allee and John Allee have the Use and Benefit of the Plantation whereon I now Live untill my Brother Presley Comes to the age of Twenty one years and Lastly I do here Nominate Constitute & Appoint Abraham Allee and John Allee my whole & Sole Executors of this my last will and Testament hereby Revoking & disannuling all other will or Wills heretofore by me made In Testamony whereof I have hereunto Sett my hand and fixed my Seal this Seventeenth Day of May Anno Domini. N B that the Legacy Left to Frances Cooper by the Said Peter Allee is to undemnnify the Said Peter Allee from and Charge that may ensue hereafter Except ye Said Frances Cooper’s wages

Personally appeared before me Caesar Rodney Esquire Register for the Probate of Wills and Granting Letters of Administration within the County of Kent on Delaware George Harris and Lucy Cooper two of the evidences to the above and within Will of Peter Allee deceased. and being severally sworn on the Holy evangelists of almighty god do say that they saw and heard the said Peter Allee the above testator sign, seal, Publish Pronounce and Declare the above and within Instrument of writing as and for his last Will and testament, that at the time of his so doing and saying he was to the Best of their Belief of sound and Disposing mind & memory that that they at his Instance and request and in his Presence signed And saw each other sign their names as evidences thereunto, that is to say the sd George Harris with his proper Hand writing and the said Lucy Cooper as by way of making her mark, and at the same time saw John Dawson sign his name as one other evidence to the same at the like Instance and request and in his Presence  also. In Testimony whereof I have Hereunto set my hand This 24th Day of May Annoque Dom. 1773 Caesar Rodney Register
