Will Abraham Allee 1770
In the Name of God Man I Abraham Allee Senr of Duck Creek Hundred and Kent County in Delaware Gentleman being Weak of body But of Sound mind and memory, Calling to mind the the mortallity of the body & knowing that all men onc dye have through prayer to make, Ordain, Constitute and Appoint this my last will and Testament, first I Recommend my Soul to god who gave it being and my body to the dust after its being buried in a Christian Like manner at the Discretion of my Execrs hereafter to be mentioned. Secondly it is my will that all my just Debts be paid at the Joint Expense of my three Execurs; Item I give and bequeath to my Eldest son John Allee all and Singular that plantation and Tract of Land Called and Known by the name of Hillyards Adventure Lying and being on the North side of a branch Called Iron’s Branch in Duck Creek hundred and Kent County afsd with all the rights Titles hereditaments and Appurtenances thereunto belonging to him his heirs and Assigns forever.
Item I give and bequeath unto my son John Allee all my Wearing Apparill With one negro boy Called prince one negro man Called old Caesar one negro girls Called Rach to him his heirs and Assigns forever,
Item I give and bequeath unto my two Daughters Mary Carpenter and Sarah Tilton all and Singular that plantation and Tract of Land Whereon Mark Cahoon now Lives Called and known by the name of Galway Lying and being in Little Creek hundred and Kent County afsd that is to Say that share or half part of the afforementioned Land and plantation Which I Give to my Daughter Sarah Tilton I give to her with all the Rights, Title hereditaments and Appurtenances thereunto belonging to her my Daughter Sarah her heirs and Assigns forever & the other half part of that Afforementioned Land and plantation I give to my daughter Carpenter During her Natural Life and then I give it to be Equally Divided Amongst the Children of my Daughter mary Carpenter begot of her body by her first Husband Henry Rothwell to them their heirs and Assigns forever. Item I give and bequeath unto my ^Two Daughters Mary Carpenter and Sabrah Tilton all and Singular the negroes Horses, Cattle and all other Stock Whatsoever that is now on the before mentioned Land and plantation Whereon the said Mark Cahoon now Lives. Together with all the Rents and profits that shall or may hereafter Accrue from the afsd Land and premises to them my daughter Mary Carpenter and my Daughter Sabrah Tilton to them their heirs and Assigns forever. that is to say the half part of the plantation before Given to my Daughter Mary is Given With this Exception to her With its half part of Stock Rents, and Profits During her Natural Life and then to the Children of her first Husband Henry Rothwell begotten her Body to them their Heirs and Assigns forever and No other.
Item I Give and bequeath unto my Daughter Sabrah Tilton one old negro Woman Called Rain, Item I give and Bequeath to my son Jonathan Allee all and Singular the plantation and Tract of Land Whereon I now Live with the Banked medew or marsh With all the other marshes a Lying along the Creek and Towards Bombay hook Excepted to him my Son Jonathan with all the rights Titles and Hereditaments thereunto Belonging to him his heirs and Assigns forever. Item I Give and bequeath to my Son Jonathan All and singular that plantation whereon Allen Palmertree now Lives Allee pasture point And a nother small parcell of Land and plantation Whereon Simon Severim now Lives Adjoining the Lands Belonging to the heirs of Hugh Talbert Deceased With other land And plantation whereon Jethro Tompson now Lives Called and known by the name of barren hope to have the afsd. Lands and premises with all their Rights Titles hereditaments and Appurtenances thereunto Belonging to Belonging to him his heirs and Assigns forever
Item it is my Will that in Consideration of the plantation Given to my Son Jonathan Called Barren Hope that my Son Jonathan pay to my four grand Children the Children Of my Son Abraham Allee Deceased to with Isaac Abraham Jacob and Mary Alleefifty pounds apiece, of good and Lawfull money Current money of this Governt as soon as each of them shall Arrive to the full age of Twenty years. Item I Give Bequeath to my Grand Son Abraham Allee the Child of Jonathan Allee one negres Boy Called Dave to him his heirs and Assigns forever. Item I Give and bequeath to my Grand Child Abraham Allee son of John Allee one young Horse for him to Take is Choice of all my Stock.
Item I give and bequeath to my dearly beloved Wife Mary Allee Two Negroes to Wit Fean and merit to her her heirs and Assigns forever with her Lawful thirds, Item I give and bequeath to my Son John Allee my Son Jonathan Allee and my Son in Law Thomas Tilton all that Quantity or parcel of marsh heretofore Excepted and not Given Lying and being along the Creek Towards Bombayhook To be Equally divided between them three and to them their heirs and Assigns forever, Item I give and bequeath to my Son Jonathan Allee the Rest and Residue of my Personally Estate Heretofore not Given and Disposed of to him his heirs and Assigns forever.
And Lastly I do hereby Nominate Constitute and Appoint my son John Allee Jonathan Allee and my son in Law Thomas Tilton my three Executors of this my Last Will and Testament Revoking and D????Disanuling All Other Will or Wills by me Heretofore made. Personally Appeared before me Caesar Rodney Esqr. Register for the probate of Wills and Granting Letters of Administration Within the County of Kent on Delaware James Tilton and John Vn. Gaskin Junr. Two of the Evidences to the Within Will of Abraham Allee decd and being Severally Sworn on the holy Evangelists of almighty god did declare that they saw and heard the said Abraham Allee Sign Seal publish pronounce and Declare the within Instrument of Writing as and for his last will and Testament. that at the time of So doing and Saying, he was to the best of their belief of Sound and Disposing mind and memory, that they signed their names thereunto as Evidences, at his instance and request and in his presence, and at the Time saw John Hawking Junr Sign his name as one other Evidence thereto At the Like Instance and Request and in his presence. In Testimony Whereof I have hereunto Set my hand this Twentieth day of August anno Domini one thousand seven hundred and Seventy. Caesar Rodney Register
Be it Remembered that on the Twentieth day of August Anno Domini one thousand seven Hundred and Seventy the Last Will and Testament of Abraham Alle Senr Deceased in due for of Law and probateand Letters Testamentary thereof Were granted to John Allee Jonathan Allee and Thomas Tilton Esquire, Executors in the Same Will Named being Sworn Well and Truly to Administer the Estate of the said Deced; and to Exhibit an Inventory thereof into the Registers Office at Dover on or before the Twentieth Day of February Next and Render a True and Just Account of their Administration When thereunto Legally Required Given under the Seal of the Said Office.
