Deed Aaron Stoops & Wife to Peter S. Collins 1847 (mentions John Collins, negro & Adam Lockwood, negro)

This Indenture made the thirty first day of August in the year of our Lord one thousand eight hundred and forty seven between Aaron Stoops of New Castle hundred New Castle County and State of Delaware and Elizabeth his wife of the one part and Peter S Collins of Duck Creek hundred Kent County in said State of of the other part Witnesseth that the said Aaron Stoops and Elizabeth his wife for and in consideration of three thousand eight hundred dollars lawful money of the United States of America paid to them by the said Peter S. Collins before the sealing and delivery of these presents the receipt whereof is hereby acknowledge have and each of them hath granted, bargained, sold, aliened enfeoffed released conveyed and confirmed and by these presents do and each of them  doth grant bargain sell alien enfeoff release convey and confirm unto the said Peter S Collins his heirs and assigns the following lands and premises that is to say All that tract or parcel of land situated in Duck Creek hundred aforesaid bounded on the  north by the road leading from the Baptist Meeting house to Kepners Mill on the East by the road leading from Smyrna to Cloak Mill from the place where the last mentioned road intersects the one first mentioned down to the corner of a piece of woodland called the Old Camp meeting ground and from the said corner of said woods in a southerly direction to the old or former race of said last mentioned Mill so as to make the whole of said last mentioned boundary one strait line thence up the north side of said Cloake Mill Pond to land late of Presley and Enoch Spruance now of Jesse S Huffington and thence with said Huffingtons land to the place of Beginning said to contain one hundred and forty acres, be the same more or less- Also all that tract or parcel of wood land part of a larger tract lying on the North side of said first mentioned road adjoining land late of Henry Green dec’d now of Emory Bailey and other land of the said Joseph Hoffecker Junior and which parcel hereby bargained and sold is bounded as follows viz. Beginning at an old Stump a part of which is standing in the middle of the Road leading the Baptist Meeting house to Kepners Mill and running thence north thirty degrees East one hundred and fifteen perches to line of land late of said Henry Green now of Emory Bailey thence north eighty eight and a half degree east seventeen perches to a Stake in the run of a branch being also a corner for the widow Pearce and for said Joseph Hoffecker Junior thence south fourteen and a half degree west one hundred and eleven and one tenth perch to the middle of said last mentioned road and thence down the middle of said road North eighty and a half degrees west to the place of Begining Containing twenty one acres more or less Including one acre heretofore conveyed by John Cummins dec’d to Ellinor Jones which is not intended to be hereby conveyed. And also all that other tract or parcel of woodland situated in Dover hundred Kent County aforesaid being part of a larger tract purchased by said Joseph Hoffecker Junior and his brother Henry D. Hoffecker of the heirs of Joseph Pennock adjoining lands of Truston L. Davis of Isaac Buckingham and others which parcel hereby bargained and sold is bounded as follows viz. Beginning at a dead white oak upon the line of said Isaac Buckingham and supposed to be a corner between him and Albert G. Lewis and running thence south twelve degrees and twenty minutes East thirty three and four tenths perches to a stake a corner of said Joseph Hoffecker junior other land thence with said Hoffecker North eighty nine degrees East seventy six and three tenths perches to a stake in the line of said Hoffecker and a corner of John Collins negro thence north twenty one and a half degrees East sixty four and eight tenths perches to a Stake thence north sixteen degrees west with land of Adam Lockwood negro seventeen and one tenth perches to a stone corner thence south eighty eight degrees west sixty five perches thence south eighty eight and one fourth degree west twenty two and two tenth perches and thence south sixty five and a half degree west twenty nine perches to the place of Beginning Containing thirty acres be the same more or less Together with all and singular the buildings fixtures woods ways waters and water courses easements improvements priveleges and appurtenances to the said three aforesaid tracts or parcels of land and to every or any of them belonging or in any wise appertaining and the reversion and reversions remainder and remainders rents issues and profits to thereof and all the estate right title claim demand interest and possibility of them the said Aaaron Stoops and Elizabeth his wife and of each of them at law or in equity to in and out of the same and every part and parcel thereof To have and To hold the said land and premises hereby bargained and sold or in tended to be with the appurtenances unto him the said Peter S. Collins his heirs and assigns to the only proper use and behoof of him the said Peter S. Collins his heirs and assigns forever: And the said Aaron Stoops and Elizabeth his wife for themselves and each of them their and each of their heirs executors and administrators do hereby further grant covenant and agree to and with the said Peter S. Collins his heirs and assigns that against themselves the said Aaaron Stoops and Elizabeth his wife and each of them and all persons claiming, or lawfully to claim by through from or under them or either of them the land and premises hereby bargained and sold or intended to be with the appertainances unto the said Peter S. Collins his heirs and assigns they the said Aaron Stoops and Elizabeth his wife shall and will warrant and forever defend. State of Delaware (to wit) Be it remembered that on this thirty first day of August in the year of our Lord one thousand eight hundred and forty seven Aaron Stoops party to the foregoing Indenture personally came before me James Booth Chief Justice of the State of Delaware and acknowledged the said Indenture to be his deed And be it further remembered that on the same day and year aforesaid Elizabeth Stoops wife of the said Aaron Stoops and also a party to the foregoing Indenture personally came before me the said James Booth and upon private examination taken by me apart from her said husband acknowledged the said Indenture to be her deed and that she executed the same willingly without compulsion or threats, or fear of her husbands displeasure.
