Will, Edmund Badger 1763

In the Name of God Aamen I Edmund Badger of the town of Dover in the County of Kent of Delaware Cordwainer being very sick and weak in body But of Perfect Minds nd Memory blessed be God therefore & Calling to Mind the Mortality of the Body & Knowing that it is appointed for all Men once to die, do make an ordain this my Last Will and testament in mannere and form following: that is to say; principally and first of all I humbly and submisiozely Recommend My Soul to the protection of almighty god who gave it me, Not Doubting but at General Resurrection by his blessing Blessing I shall again Reasure it and be united to the body, through the infinite Merits and Mercy of Jesus Christ our Saviour and my body I Comit to the Earth to be buried in a Christian like and decent manner, at the Discretion of my hereafter Named; and as touching Such Worldly Substance as it hath pleased God to Bless Me with, in this Life, I dispose of the ^same in the following Manner & form Impremus I will and Bequeath to my Eldest Son Eleazor Badger, the Lot of Ground in the  town of Dover Called and known by the Name of the old gaol Lot, together with all the Building & appurtenances thereunto belonging to be fully Enjoyed by the said Eleazor Badger during his Natural Life, and after his Deceas, then my Will is the said Premises devolves to the heirs of his Body Lawfully begotten to be  Enjoyed by them theirs heirs and assigns for Ever. but if the said Eleazor Badger should die without Legal heirs as aforesaid, then in that case my Will is,  That the aforesaid lot & Premises desend to the Lawful Issue of my second son Edmund Badger to be Enjoyed by them the said Legal Issue their heirs &  assigns for Ever. Item I will and Bequeath to the publick society of the people Called Quakers, Particularly those that are belonging to the Little Creek Meeting as Gardians to the Same, half an acre of Ground Whereon to build a Meeting house for Said Society, to be laid of at the North End of the Lot of Ground adjoining North street & high street of such a Breadth as to make the half acre on the Said North Street all the way from High street to the Lot of Ground Now belonging to thomas Shillington, to be Enjoyed as a meeting house Ground to & by the Said Society for Ever. Item I Give and bequeath to my son Edmund Badger, the Large Brick house I now Live in, on the west side of the square of Dover Green, and all the Lots of Ground belonging to the same, entirely to high street and joining to the one half acre of ground left to the society of Quakers above Mentioned; to be Enjoyed by the Said Edmund Badger during his Natural Life, and after his Deceas My Will is that it be Enjoyed by the Lawful Issue of his Body by them, the said Issue, their heirs and assigns for Ever. Item. I will and bequeath to my Said Son Edmund Badger, under the same Tenure and the ????? As the House and Lots about Mentioned, all that tract of Land and Plantation adjoining to the lands of Vincent Loockerman & others which I purchased from Thomas Floyd to be Enjoyed by said Edmund Badger his life Time and afterward by his Lawfull Issue and theirs heirs and assigns for Ever ^I purchased from Thos Nixon and Peter Comegys. Item I Will and bequeath to My Well beloved Wife Letitia Badger, one Negro female Child Called Binah, and one Set of Bed Curtains of Calico which She Bought herself and also a Mare Called Tib and her Side Saddle, all these to be her property and to Enjoy to her, her heirs and assigns for Ever. also My Will is, that after My Just Debts is paid that She have one third part of the Residue of my Personal Estate for Ever. & also one third part of the Rents of my Real Estate her Life time also My Will is that my Negro boy Cato be sold to help to pay my Debts, to whom I leave my Every Day Wearing Coat, Jacet & Breeches;  also I leave and Bequeath all My other waring apparel to my Son Edmund Without appraisement. also all the Leather & Hides in Tan: and Shoemakers tools without appraisement Also I Nominate Constitute & appoint Samuel McCall of the town of Dover, Practitioner in fiscik to be the Executor of this my Last Will and Testament Ratifieing and Confirming this and No other to be my Last Will and & testament Revoking & disanuling all former wills by me made In witness whereof I have hereunto Set my hand and fixed my seal this fourteenth Day of December Annoque Domino one thousand Seven hundred and Sixty three. Be it Remembered, and it is My Will as a Schedule to the above, That after My wife having had her thirds of My personal Estate the Legal Debts and funeral Charges being first paid that after said affairs being Settled, I Give and Bequeath all the Residue of my personal Estate to my son Edmund Badger to be Enjoyed by him his heirs ad assigns for Ever. as Witness My hand and this fifteenth Day of December Annoque Domini Seventeen hundred Sixty three Edmund Badger {seal}

Personaly appeard before me the subscriber Richard Well Esquire, Thomas Skillington and James Maning Evidences to the Within Will of Edmund Badger Deceased and the Said Thomas Skillington, and James Maning, also appeared as Witnesses to above schedule to the Said will, and Being Severally Sworn, do declare that they Saw and heard the testator Edmund Badger Sign, Seal, published pronounced, and declared, the within Instrument of Writing, and the above Schedule then to as and for his last Will, and testament, and that at the time of his doing and Saying the Same he was (to the best of their behoof) of sound and Disposing Mind, and Memory, and that they Signed their Names as Evidences should at his Request, and in his presence In testimony whereof I have hereunto Set My hand this 19th Day of December 1763. Casar Rodney Deputy Register for the probate of Wills and Granting Letters of Administration of, in and for the County of Kent on Delaware, Under the Honorable John Penn Esquire Lieutenant Governor and Commander in Chief of the Counties of Newcastle Kent Sussex on Delaware and province of Pennsylvania.

To all Unto whome these presents Shall Come Greeting Know ye that on the Nineteenth Day of December one thousand Seven hundred and Sixty three at Dover in Kent County aforesaid, Was proved, approved and insinuated the last will and testament of Edmund Badger late of the County aforesaid, deceased, having while he lived and at the time of his Death, Goods, and Chattles, Rights and Credits, in Divers places within the said County, by Means whereof the Full Disposition of all and Singular the Goods and Chattles, Rights and Credits of the Said Deceased, and the Granting Administration thereof, as also hearing the accounts, Calculations and Reckoning of the Said administration, and the final Discharges, and Dismission therefrom, unto Me and Manifestly known to belong; and the Administration of all and singular the Goods and Chattles Rights and Credits of the Said deceased his last Will and testament, any manner of way covering, was graded unto Samuel McCall Executor in the same testament named; Chiefly of well and truly administering the Same, and makeing a true and perfect inventory and Concionable appraisement of all and singular the Goods and Chattles, Rights and Credits of the said Deceased and Exhibiting the same unto the Registers office at Dover in Kent aforesaid, on or before the nineteenth Day of June next Ongoing the date hereof, as also of rendering a just and true account of the said administration when there unto Required (being Solmnly Sworn thereto) In Testimony Whereof I have Caused the Seal of the Said office (which I use) to be hereunto affixed at Dover in Kent County aforesaid this Nineteenth Day of December in the fourth Year of the Reign of our Sovern Lord King George thethird Annoque Domini one thousand Seven hundred and Sixty three.
