Will Peter Brinckle 1764

In the Name of God Amen this Tenth day of January in the year of our Lord one Thousand Seven Hundred Sixty four, I Peter Brinckle of Little Creek hundred and County of Kent on Delaware being Very Sick and Weak in Body by of Perfect mind and memory thanks be given to god Therefore Calling unto mind the Mortality of my Body, and knowing that it is appointed once for all men to Die do make and ordain this my last will and Testament. That is to Say Principally and first of all I give and Recommend my Soul into the hands of god that gave it. And for my Body I Recommend it to the Earth to be Buried in a Christianlike and Decent Manner at the Discretion of my Executor, Nothing Doubting but at the general Resurrection, I Shall Receive the same again by the mighty Power of God. And as Touching Such worldly Estate as ????with it hath Pleased God to bless me with in this Life, I give Devise and Dispose of the Same in the following manner and form Imprimis it is my will and I do ordain, that in the first place, all my Just Debts and Funeral Charges to be paid and satisfied. Item I give and bequeath unto Mary my Wife the third of all my Lands During her natural life And my best bed and furniture thereunto belonging and the Third of all my Personally Estate, to her and her use forever Item I give Devise and bequeath unto my son William Brinckle, the Plantation whereon I now Dwell to him his heirs and assigns forever I likewise leave my Son William Brinckle a sorrel Horse Called Rock and a Saddle and Bridle to him and his use forever. Item I give Devise and bequeath unto my son Jesse Brinckle my Plantation in Murtherkill forrest on the North side of Cow Marsh, Binding on a Tract of Land Called Cabben Ridge to him his heirs and assigns forever Item I give Devise and bequeath unto my son Peter Brinckle my Plantation which I bought of Thomas Irons Lying near Muddy Branch Bridge, and joining to Thomas Parkers Land, and to the Plantation whereon I now Dwell, to him his heirs, and assigns forever Item I give and bequeath unto my Daughter Mary Brinkle a Negroe Girl Named Kate, and her increase, to be Delivered to her when she Comes to the age of Sixteen years And further it is my will and I do so order, that if my son Peter Brinckle Dies before he comes to To the Age of Twenty one years, then the Land which I left him shall belong unto my son William Brinckle his heirs and assigns forever, only my son William Brinkle, must Pay my Daughter Mary Brinckle the sum of Twenty Five Pounds Current Lawful Money of the Government, when she comes to the age of Sixteen years And if my son Jesse Brinckle Dies before he comes to the age of Twenty one years, then the Land that I Left him shall be Equally Divided between my Two Sons, William Brinckle and Peter Brinckle (their Heirs and assigns forever) only the said William Brinckle, and Peter Brinckle must Pay my Daughter Mary Brinckle the Sum of Twenty five Pounds (current Lawfull Money as aforesaid) when she comes to the age of Sixteen years And if my son William Brinckle Dies before he Comes to the age of Twenty one years, then the Plantation which I Left to him shall belong unto my son Peter Brinckle (his heirs and assigns forever) only son Peter Brinckle must Pay my Daughter Mary Brinckle the sum of Twenty Five Pounds (Currant Lawfull Money as aforesaid when she come to the Age of Sixteen years And Lastly I do make Constitute and ordain Mary my Wife and William Brinckle my son my whole and Sole Executors of this my last will and Testament and I do hereby utterly Disallow, Revoke and Disannul, all and every other former Testaments, Wills Legacies and Executors, by me Any ways before this time Names, Willed and bequeathed, Ratifying and Confirming, this and no other to be my last Will and Test In Witness whereof I have hereunto set my Hand and seal the day and year first above Written. Signed, Sealed Published Pronounced and Declared By the said Peter Brinckle as his Last Will and Testament in the Presence of us the Subscribers John Keith John Hamilton Thos Freeman

Personally appeared before me Casar Rodney Deputy Register for the Probate of Wills and Granting Letters of Administration within the County of Kent on Delaware, John Hamilton and Thomas Freeman, Two of the subscribing Evidences to the above Will of Peter Brinckle Deceased and being sworn on the Holy Evangelists of almighty God declared that they saw and heard the Testator sign seal Publish, Pronounce and Declared the above Instrument of Writing as and for his Last Will and Testament that at the Time of so Doing and saying he was (to the best of their belief) of sound and Disposing mind and Memory that they signs their names as Evidences thereto at his Instance and Request, and in his Presence and at the same Time saw John Keith sign his name as one other Evidence thereto at the like Instance and Request, In Testimony whereof I have here unto set my hand this 30th Day of March anno Domini 1765.
