Deed Julia Ann Purnall et al to William Whipper 1872

This Indenture made the Thirteenth day of September in the year of our Lord one thousand eight hundred and Seventy two, Between Julia Ann Purnell of the City of Philadelphia in the State of Pennsylvania, wife of James Whipper Purnell of the same city And the said James Whipper Purnell, Adelaide Amelia Wormley of the City of Washington in the District of Columbia wife of William Henry Ashburton Wormley, of the same City And the said William Henry Ashburton Wormley And Marian Purnell Shadd, of said City of Washington, Spinster of the First Part, Eliza Julia Anderson of said City of Washington Widow and Executrix of Absalom Williams Shadd, late of the Township of Raleigh, in the County of Kent, And Province of Ontario yeoman deceased And now the wife of Duke William Anderson of said City of Washington Gentleman of the Second Part, William Whipper of the City of New Brunswick in the State of New Jersey Gentleman of the Third Part And the said Duke William Anderson of the fourth Part Whereas the said Absalom Williams Shadd And the said William Whipper were Tenants, in common of certain Lands in the Village of Dresden, in the said County of Kent, including the Lands hereinafter mentioned and described, And whereas the said Absalom Williams Shadd departed this life in or about the month of June, One thousand, eight hundred and fifty seven, And by his Last Will and Testament duly executed to pass real Estate, in Ontario and bearing date the tenth day of June, One thousand Eight hundred and fifty Seven,  did after certain devises therein act further devise and bequeath unto Julia Ann Shadd (now Purnell) Adelaide Amelia Shadd (now Wormley) And Marion Purnell Shadd the residues of his real and personal Estate, including his Estate in the lands so held in common, as aforesaid, And whereas by a certain Report and Order, confirming the same issued out of the County Court of the aforesaid County of Kent, in the matter of Partition Between said Wiliam Whipper And said Eliza Julia Shadd, Adelaide Amelia Shadd Julia Ann Shadd, And Marion Purnell Shadd, bearing date the Sixth day of July 1861, the Lands hereinafter mentioned and conveyed, now Apportioned And became vested in said William Whipper, And the remainder of the Lands so held, in Common as aforesaid were apportioned to and became vested in the said Julia Ann Shadd, Adelaide Amelia Shadd, And Marion Purnell Shadd, And Whereas doubts have arisen, respecting the said matter of Partition And as to the regularity of the Proceedings therein And the validity of the said report And Order, And Whereas in Order to set at rest, such doubts as aforesaid, and to confirm the title of the said William Whipper, in the Lands hereinafter mentioned the said William Whipper has requested the said parties of the first And Second Parts, to execute these Presents, And they have consented so to do, Now This Indenture Witnesseth that in pursuance of the premises, And in consideration of the sum of Five shillings of Lawful money of Canada, now paid by the said party of the Third Part to the said Parties of the First Part, (the receipt whereof is hereby by them acknowledged) they the said parties of the First Part, do and each of them Doth Grant Release and quit claim, unto the said party of the Third Part his heirs and Assigns Forever, All the Estate right Title Interest claim, and demand, whatsoever, both at Law and in Equity or otherwise howsoever, and whether in possesion or expectancy of them the said parties of the First Part, of in, to or out of

All And Singular those certain parcels or tracts of Land And Premises, situate lying and being in the said Village of Dresden, in the County of Kent, And composed of, and being Lot Numbers Ninety Seven, Ninety Eight, Ninety Nine, One hundred, One hundred and Four, One hundred and five, One hundred and Six, One hundred and Seven, One hundred and Eight, One hundred and nine, One hundred and Ten, One hundred and Eleven, One hundred and twelve, One hundred and thirteen, and One hundred and Fourteen on Medical Avenue, in the said Village, also Lots Numbers two, four, five, Six, Seven, Eight, Nine, Ten, Eleven, twelve, Thirteen, Fourteen, Fifteen, Sixteen, Seventeen, and Eighteen, in Block “G” Lots Numbers Five, Six, Seven and Eight in Block “B” Lots Numbers Nine, Ten, eleven, twelve thirteen fourteen fifteen, Sixteen, Seventeen, and Eighteen, in Block F all of Block “L” saving And excepting Lot Number Four, all of Block “E” Lots  Numbers Two, three, four and Five in Block I and all of Block K saving and excepting Lot Number Eight, all as laid out And Numbered upon a Map or plan of part of Lot Number Four, in the fourth and fifth Concessions of the Gore of Camden in said County of Kent, made by Richard Parr, Esquire, P h S,

To Have and to hold, the same unto the said party of the third Part, his heirs And Assigns to and for his and their sold and only use Forever, Subject nevertheless to the reservations limitations provisoes, And conditions expressed in the original Grant from the Crown And this Indenture further Witnesseth that the said party of the Second Part, in consideration of the premises, And of the sum of five shillings, of Lawful money of Canada to him in hand paid by the said party of the third part, (the receipt whereof is hereby acknowledged,) Doth Grant Release and Quit claim unto the said party of the Third Part, his heirs and Assigns for ever, all the estate, right title interest, claim, and demand whatsoever both at for and in Equity whether for Dower or otherwise howsoever, And whether in possession or expectancy of her the said party of the Second Part, of in to or out of all and Singular the lands and tenements hereinbefore described And conveyed, And also all Right title Claim or demand whatsoever which she the said party of the Second Part, might have in or to the rents issues And profits of said Lands, under the Will of her said deceased husband, And the said party of the Fourth part, hath become a party to these Premises for the purpose of confirming and ratifying, and Doth hereby assent to confirm And ratify the same, In Witness whereof said parties hereto, have Hereunto set their hands and Seals,

Kertwright, Her Brittanic Majestys Consul for the State of Pennsylvania Esquire, do hereby certify that on this nineteenth day of of September in the year of our Lord, One Thousand Eight hundred and Seventy two, at the City of Philadelphia in the State of Pennsylvania one of the United States of America, the within Deed was duly executed in my presence, by Julia Ann Purnell of the said City of Philadelphia, wife of James Whipper Purnell, one of the Grantors therein named, and that the said wife of the said James Whipper Purnell at the said time and place being examined by me apart from her husband did appear to give her consent to convey her estate in the lands mentioned, in the said Deed freely and voluntarily, and without coercion or fear of coercion on the part of her husband or of any other person or persons whatsoever, sgd Charles E, K.
