Articles of Agreement made and concluded on the Thirteenth day of February in the year of our Lord one Thousand eight hundred and nine Between Benjamin Warren of Kent County in the State of Delaware Surviving Administrator of the Goods and chattell rights and credits of John Warren late of said County dec’d on the one part and Samuel Warren of the County afsd of the other part witnesseth that the said Benjamin Warren on his part doth hereby Covenant & agree to and with the said Samuel Warren to deliver to the said Samuel Warren a parcel or quantity of goods & Chattels that were formerly the property of said John Warren among which is one negro Girl named Juda one negro man named Fall one do Girl Violett and one do Boy Anthony and a number of Cattell with other Articles which said Goods are to be appraised to the said Samuel Warren by two men and to be ???? By each of said parties and the said Benjamin Warren further agrees to Mae and execute to the said Samuel Warren and his executors admr or assigns a Bond for the sum of one thousand dollars with a power of attorney annexed thereto to confess Judgement thereon which bond shall bear ??? Date with these presents and the said Benjamin Warren further agrees to make and execute to the said Samuel Warren a legal Letter of Attorney therein authorizing and confirming the said Samuel Warren in the same place and that of him the said Benjamin to Collect all monies due to the said John Warren and to pay the debt of said John Warren and to do and suffer all and any matter or thing necessary to be done in order to settle the Estate of said John Warren. And the said Samuel Warren on his part doth hereby Covenant and agree to and with the said Benjamin Warren and his Executors or Adms to take the afsd goods or whatever goods the said Benjamin Warren may deliver to him at the sum or sums of money the same may be appraised to by the men to be appointed as afsd. and that he will apply the amount thereof to settle and pay the debts of the said John Warren as soon as he conveniently can after the sale of said goods and the money therefor an be collected and that he the said Samuel Warren by Virtue of said power of attorney to be made and executed to him the said Samuel Warren by the said Benjamin Warren as afsd will proceed to settle the Estate of said John Warren as far forth as the property put into his hands shall account as soon as he reasonably or conveniently can. And whereas the before mentioned Bond is to be Executed and given to the said Samuel Warren by the said Benjamin Warren for the purpose of indemnifying and securing the said Samuel Warren from any damage he may sustain in consequence of his becoming surety or Bondsman to the said Benjamin Warren and Elizabeth Warren decd for the faithful performance of their Administration on the Estate of said John Warren decd the said Samuel Warren further agrees that if the said Benjamin Warren shall and do from time to time and at all times when thereto requested by the said Samuel Warren ???? Sum or sums of money which together with the amount of the goods to be delivered and appraised as afsd to the said Samuel Warren as shall amount in the whole to as much as the said Benjamin Warren has himself received from the Estate of the said John Warren, and also indemnify and ???? harmless the said Samuel Warren and his heirs Executors & Administrators of and from all damage Costs or charges that he or they may sustain in consequence of his the said Samuel Warren becoming bondsman for the said Benjamin & Elizabeth Warren for their faithful performance of their duty as Administrators of John Warren decd then and in such Case said Bond with every ???? And Claim thereof shall be nul & Void and the said parties further agree that the said goods shall be delivered to the said Samuel Warren and appraised as afsd on or before the twentyeth day of this Instant. For the faithful performance of all and singular the Covenants and agreements afsd the said parties bind themselves their heirs Executors and administrators Each to the other in the penal sum of Three Thousand dollars.
