Samuel Warren Senior
This is the last Will and Testament of Samuel Warren senior of Murderkill Hundred Kent County and State of Delaware. First I will and bequeath to my beloved wife Miriam after my Debts are paid all my personal property except such as is hereinafter specifically bequeath
Second I give and bequeath to my beloved wife Miriam a Negro girl named Emily and all the children of the said Emily.
Third I give and devise to my beloved wife Miriam for and during the term of her natural life without impeachment of Waste all that Farm with the appurtenances now in the tenure of Gord Cox situate in Mispillion Hundred Kent County and State of Delaware containing one hundred and sixty acres more or less and after the death of my said wife I give and devise the said Farm with the appurtenances unto my son Solomon Townend Warren his heirs and assigns forever.
Fourth I give and devise to my beloved wife Miriam for and during the term of her natural life without impeachment of waste all that Farm or tract of land with ^the appurtenances situate in Mispillion Hundred, Kent County and State of Delaware being the Mansion farm on which Solomon Townsend senior and Solomon Townsend Junior lived and died and now in the tenure of Abner Wooten and containing six hundred acres more or less and from and immediately after the death of my said wife, I give and devise the said farm or tract of land with the appurtenances unto Solomon Townsend Warren and John W Hall and their heirs for and during the natural life of my daughter Mary Darby now the wife of John M Darby. Upon Trust to receive the rents and profits thereof and to pay the same to my said daughter Mary during her natural life for her sole and separate use, notwithstanding her coverture, free from the debts management power control of her now husband the said John M Darby or of any other husband by her hereafter to be taken and the receipt of the said Mary along from time to time to be a sufficiently discharge, and after the death of my said daughter, I give and devise the farm or tract of land aforesaid with the appurtenances unto the heirs of my said daughter Mary in fee simple absolute clear and discharged from the Trust afotesaid
Fifth I give and devise unto Solomon Townsend Warren and John W. Hall and their heirs for and during the natural life of my daughter Mary Darby now the wife of John M. Darby the Farm or tract of Land which I purchased of Dr. Alexander Lowber, near Frederica containing five hundred acres more or less with the appurtenance Upon Trust to receive the rents and profits thereof and to pay the same to my said daughter Mary during her natural life for her sole and separate use, notwithstanding her coverture, free from the debts management power or control of her now husband the said John M Darby or of any other husband by here here after to be taken, and the receipt of the said Mary alone from time to time to be a sufficient discharge and after the death of my said daughter I give and devise the Farm or Tract of land aforesaid unto the heirs of my said Mary in fee simple absolute clear and discharged from the Trust aforesaid.
Sixth I give and bequeath unto my daughter Mary Darby now the wife of John M. Darby one negro girl Elizabeth and one negro girl Sarah to be held by her for her own sole and separate use notwithstanding coverture entirely free clear and discharged of and from all debts contracts incumbrances and liabilities of her said husband now or hereafter to be contracted and without being in any wise subject or liable to the management power or control of her now husband the said John M. Darby or of any other husband by her here after to be taken
Seventh I give and devise unto my son Samuel Warren Junior his heirs and assigns forever all that Farm with the appurtenances on which he now resides containing three hundred and sixty acres more or less adjoining lands of Susannah Warren and lands formerly of Charles Rowland and also adjoining St Jones Creek. I also give to my son Samuel all my book account that I now have against him so as to release him from all liability to my estate furor by reason of any balance that may be due from him on a settlement thereof. I also give and bequeath to him my negro boy named Elijah
Eighth. I give and devise unto my daughter Eliza Ann Virden and Samuel Virden during their joint lives and the live of the survivor of them my Mansion Farm with the appurtenances bounded on the south side by the Barratt tract of land as lately surveyed by a certain Henry Todd and on the North by land of William Hirons and containing three hundred acres more or less, and after the death of my said daughter Eliza Ann Virden and Samuel Virden and after the death of the survivor of them I give and devise the said tract of land with the appurtenances unto my son Solomon Townsend Warren his heirs and assigns forever, he paying unto my son Samuel Warren Junior and his heirs one Thousand dollars.
Ninth. I give and bequeath unto my daughter Elis Ann Virden a negro girl named Mary. Tenth I give and devise unto my son Solomon Townsend Warren his heirs and assigns forever all that Farm with the appurtenances on which he now resides known by the name of the Barratt tract lately surveyed by the afororesaid Henry Todd and containing one hundred and fifty two acres more or less bounded on the south side by lands of Edward Anderson, on the west By lands of Thomas Vickery on the North by lands of James Lindale William Hirons and my Mansion Farm as I had the division line run by the said Henry Todd and on the south east by Murderkill Creek. And whereas I hold certain bonds and notes against my said son Solomon Townsend Warren amounting in all to the sum of Four thousand dollars more or less I do hereby release him therefrom so as to discharge him from any liability to me Estate. I also give and bequeath to my ^ said son Solomon Townsend Warren one negro man named William one negro boy named Caleb one negro boy named Andrew one negro girl named Martha and my hone and razors.
Lastly I do hereby nominate constitute and appoint my son Samuel Warren Junior the Executor of this my last Will and testament
In Witness whereof I have hereunto set my hand and sea this twenty eight day of December in the year of our Lord one thousand eight hundred and forty four hereby publishing pronouncing and decling this to be [my last] Will and testament and reviking all other w[ills] [writing cut off by a piece of paper]
The State of Delaware }
Kent County ss } William Hirons one of the subscribing witnesses to the foregoing instrument of writing purporting to be the last will and testament of Samuel Warren senior late of Murderkill Hundred Kent County deceased comes before John Roughly Register for the probate of Wills and Granting Letters of Administration in and for Kent County aforesaid and being solemnly swornon the Holy Evangels of Almighty God deposeth and saith that he saw the said Samuel Warren senior the testator sign the said instrument of writing and also saw him seal the same and heard him publish pronounce and declare the same as and for his last will and testament that at the time of his so doing he was of sound disclosing mind and memory and upwards of twenty one years of age that this deponent attested and subscribed his name as a witness to the said instrument of writing at the instance and in the presence of the said Samuel Warren senior the Testator and that he saw Edward Anderson the other subscribing witness to said instrument of writing also sign his name thereto at the instance and in the presence of the said Samuel Warren senior, but that the said Edward Anderson residing in the State of Pennsylvania and cannot be obtained for the purpose of proving the execution of said instrument of writing and further that the name of the Edward Anderson set to said instrument of writing as a subscribing witness is so set in the proper hand writing of the said Edward Anderson. And further the deponent saith not. William Hirons
Subscribed and sworn this 6th day of November AD 1848 BeforeJohn Raughley Regr.
The State of Delaware Kent County, Ss Edward Anderson, one of the subscribing witnesses to the foregoing instrument of writing purporting to be the last will and Testament of Samuel Warren senior late of Murderkill Hundred, Kent County deceased comes before John Raughley Register for the probate of wills and granting Letters of Administration in & for Kent County and being solemnly sworn on the Holy Evangels of Almighty God, deposeth and saith that he saw the said Samuel Warren senior the testator sign the said instrument of writing and also saw him seal the same and heard him publish pronounce and declare the same as and for his last Will and Testament; that at the time of his so doing he was of sound & disposing mend and memory and upwards of twenty one years of age: that this deponent attested and subscribed his name as a witness to the said instrument of writing at the instance and in the presence of the said Samuel Warren senior, the testator & in the presence of the other subscribing witness.
