Deed of Mortgage w Slaves as Collateral George Robisson and wife Lois to John Vining 1750

This Indenture Made this twenty Second Day of November in the Year of our Lord Christ One Thousand Seven Hundred and fifty By and Between George Robisson and Lois his wife of Kent County on Delaware of the One part and John Vining Esqr of the same place of the other part Witnesseth That the said George Robinson and lois his Wife for and in Consideration of the sum of fifty five pounds Current Money of the Government to him in hand paid by the afsd. John Vining the Receipt whereof they hereby Acknowledge they the said George Robisson and lois his Wife have bargained & Sold and by these Presents do bargain and Sell and Sett over unto the said John Vining two Negro Man Slaves, to Wit, One called and known by the name of Mingo, and the Other called And known by the Name of Hercules, Now in the Possession of the Grantors being to have and to hold the above Negro Man Slaves Mango and Hercules each every of them unto the said John Vining his heir Executors Administrators and Assigns as his or their own proper Goods and Chattles for Ever, and the said George Robisson & lois his Wife their heirs Executors & Administrators Each and every of the said Slaves unto the said John Vining his heirs Executors & Administrators from and again[st] All persons shall and will Warrant Against and Defend by these presents Provided at [page cut off] and it is the true intent and Meaning of these presents That if the Said George Rob[isson page cut off] lois his Wife or either of them they or [page cut off] and so will and Truly pay or Cause to be paid unto the said John Vining his Heirs Executors Administrators and Assigns the Just and full Sum of fifty five pounds Current Money of this Government at One entire payment and that at or before the Twenty Second Day of November which will be in the year of our Lord Christ One Thousand Seven Hundred and Fifty three with Lawfull Interest for the same from the Date hereof that then these presents and every thing herein Contained shall Cause Determine and be Void any thing herein Contained to the Contrary in any wise Not withstanding But if Default shall be made in the Payment of the afsd Principal Money or Interest Contrary to the above Proviso, then it shall and may be Lawfull for the said  John Vining his heirs Executors Administrators and assigns at any time after the afsd Twenty Second Day of November which will be in the year of our Lord Christ One Thousand Seven hundred and fifty three as afsd. To take have hold Possess & Enjoy the afsd two Negro Man Slaves Mingo and Hercules for ever in whose hands or Possession soever they shall be at the Expiration of the Term afsd as his own proper Slaves. And the sd. George Robisson and lois his Wife for themselves their heirs Executors and Administrators, Do by these presents Remand Release and for Ever Quitt Claim unto the said John Vining, his heirs Executors Administrators & Assigns of in and to all their Right Title Power Equity of Redemption of and in the afsd Bargained and Sold Negro Slaves in Default of payment as afsd. And the afd. George Robinson and Lois his Wife for themselves their Heirs Executors and Administrators Doth Covenant Promise and grant to and with the afd. John Vining his heirs Executors Administrators & Assigns that they the said George Robisson & lois his Wife, nor either of them, hath not at any Time or Times made, done Committed wittingly or Willingly Suffered Any Act, Mattor or thing whatsoever whereby or by Reason whereof the said hereby bargained and Sold Slaves or Premises or either of them, is are, shall or may be Charged or Impeached in Title Charge or other wise, And that they the said George Robisson and lois his Wife, Now have full power and Lawfull Authority to Bargain and Sell the same And as a further Security for the afd Sum of fifty five pound Current Money as afd. In Cause either or both of the afd Slaves shall Die or be Disabled before the said Twenty second Day of November which will be in the afd. Year of our Lord Christ, One Thousand Seven Hundred and fifty three, by any means whatsoever, the said George Robinson and lois his Wife, Doth Covenant Grant and Agree for themselves their heirs Executors & Administrators That such One or both of the afd. Slves dieing or disabled as afd. shall be the Property of them the said George Robisson & lois his Wife their Heirs Executors and Administrators, And not otherwise, And they the said George Robisson and lois his Wife do further Covenant for themselves their Heirs Executors & Administrators That at all Times hereafter at the proper Costs & Charges in Law of the afd. John Vining his heirs Executors Administrators and Assigns They will do or suffer to be Done such further Act and Acts, thing & things for the better Securing and making sure the afd. Sum of fifty five pounds Current Money afd. as by the said John Vining his Heirs Executors Administrators and Assigns or his or their Council Learned in the Law shall be reasonably Devised Advised or Required. Kent County To wit Be it Remembered That George Robisson and lois his Wife come into the adjourned Court of Common Pleas held at Dover Town in and for Kent County on Delaware on Thursday the Twenty Second Day of November Seventeen hundred and fifty, And did their Acknowledge the wishing Deed unto John Vining Esqr. with  the Premises thereon Specified to be his Right and Property According to the Purport and Effect thereof And at the same time the within named Lois Robisson wife of the afd. George being Privately Examined out of the hearing of her said Husband, Did Acknowledge that she became a partie to the within Deed of Mortgage of her own free and Voluntary [Will] and Comfort without any threats from her said Husband In Testimony whereof [page cut off] & County aforesaid.
