This Indenture made this eighteenth day of February in the year of our Lord one thousand Eight hundred and Eighteen Between George S Ellis of Murderkill Hundred Kent County and State of Delaware (Free negro) of the one part and James Kerbin of the hundred County and State aforesaid of the other part. Whereas Cuffee Ellis Father of the aforesaid George S Ellis died intestate in his life time and at the time of his death was seized in his demesne as of fee of and in a certain message or Lot of ground situate on the East side of King Street continued of the town of Dover containing half an acre more or less leaving to Survive him a widow named Diana Ellis who is since dead and five children viz the aforesaid George S Ellis his Eldest son Nancy Ellis Venus Ellis Stephen Ellis and Nathaniel Ellis as his heirs at Law and whereas the aforesaid George S Ellis by his Petition and application to the orphans Court of Said County of Kent Bearing date the sixteenth day of August in the year of our Lord one thousand Eight hundred and Seventeen obtained an order of Said Court wherein Martin W. Bates Joseph H. Raymond Charles Kimmey Andrew Dill and Jacob Furbee were appointed to go upon view and divide the messuage and lot of ground aforesaid among the Children and other heirs of the said Cuffee Ellis decd. and whereas the said freeholders did make their return on said order at an Orphans Court held at Dover in and for Said County of Kent on this eighteenth day of February Eighteen hundred and Eighteen and did certify and make known to the said Court that the messuage Lot of ground & Premises aforesaid would not bear any division among the Children and heirs of the said Cuffee Elliss decd. without prejudicing and spoiling the whole and did by their said return value and appraise said Lot of ground and Messuage at one hundred and fifty Dollars and which said messuage and Lot of ground and premises on the day and year aforesaid by a decree of the said Court was ordered to the Said George S. Ellis his heirs and assigns forever all which proceedings therein and thereon had may more fully and at large appear on refference being had to the records and Proceeding of the orphans’ Court of Said County of Kent and whereas the Said George S. Elliss is and now Stands Seized in his demesne as of fee of and in the messuage Lot of ground and premises aforeseid and the Said George S. Elliss is now by these presents about to grant bargain and sell the said Lot of ground and premises to the Said James Kerbin his heirs and assigns forever. Now this Indenture witnessed that the said George S. Elliss for and in Consideration of the Sum of Two hundred and twenty five Dollars lawful money of the United States of America to him paid by the said James Kerbin at or before the Sealing and delivery of these presents the receipt whereof the said George S Elliss doth hereby Acknowledge and thereof doth acquit and discharge the Said James Kerbin his heirs Executors and administrators forever Hath granted bargained and Sold alien enfeoffed released and Confirmed and by these presents doth grant bargain and sell alien enfeoff release and Confirm unto the Said James Kerbin his heirs and assigns forever all the aforesaid messuage and Lot of ground situate on the East Side of Kings Street continued of the town of Dover as aforesaid and which is comprized and Contained within the following metes and bounds that is to Say Beginning at a Corner of a Lot of Ground conveyed by John Bell Sen to Peter Fury but now belonging to Joseph Robinson and is distant north Eight degrees East five and a Quarter perches from a Stone a Corner now of Said Robinsons Lot and Lot now belonging to Manlove Hayes from the Said Beginning and extending from thence by and with the East side of Kings Street Continued as aforesaid north Eight degrees East two perches and ten feet and four inches to a corner in the line of a lot now belonging to the Said James Kerbin and thence extending with the line of Said Kerns Lot in the grant hereby to be made in two lines Paralel to the to now belonging to the aforesaid Joseph Robinson that is to Say north seventy six degrees East Seventeen perches and nine tenths and north sixty two degrees and fifteen minutes East Seventeen perches and one Quarter of a perch to a Stake for a corner thence South Eight degrees West two perches ten feet and four inches to a Stake at the corner of the Lot of ground of the aforesaid Joseph Robinson from thence by and with the two lines thereof as follows vizt. South Sixty two degrees and Fifteen minutes west Seventeen perches and one quarter of a perch and South seventy six degrees west Seventeen perches and nine tenths of a perch to the place of Beginning Containing and laid out for half an acre of Ground Strict measure be the Same more or less with the appurtenances thereunto belonging together with the reversion and reversions remainder and remainders yearly and other rents issues profits and services of the aforesaid Messuage Lot of ground and premises herein mentioned to be bargained and Sold or meant mentioned or intended to be hereby bargained and Sold and every part and parcel thereof and also all Houses orchards Gardens fields fences woods under woods timber and trees ways waters and water Courses and improvements and appurtenances thereunto belonging or in any wise appertaining and also all the Estate right title interest property claim and demand whatsoever of him the Said George S. Elliss of in and to the messuage Lot of Ground and premises aforesaid and of every part and parcel thereof. To Have and to hold all and Singular the Messuage Lot of Ground and premises aforesaid herein before mentioned to be bargains and sold and of every part and parcel thereof with the appurtenances unto the Said James Kerbin his heirs and assigns forever. To his and their sold and proper use and uses forever and To and for no other use intent and purpose whatsoever. And the Said George S. Elliss the messuage Lot of ground and premises aforesaid herein before granted bargained and sold to the Said James Kerbin his heirs and assigns forever against himself and his heirs and against all and every other person and persons whatsoever lawfully Claiming or hereafter lawfully to Claim the same by from or under him them or any of them shall and will at all times forever hereafter warrant and Defend by these presents.
