This Indenture made this 13th day of January in the year of our Lord one thousand eight hundred and twenty nine Between James Harman (Colored Man) formerly St Jones’s hundred but now of Dover hundred in the county of Kent and State of Delaware of the one part, and David Hopper of the same hundred county and State aforesaid (Coulared Man) of the other part. Witnesseth That the said James Harmon for and in consideration of the Sum of two hundred & Sixty Six Dollars & Sixty Six cents good and Lawful Money of the State aforesaid to him in hand paid by the said David Hopper at or before the Sealing and delivering of these presents the receipt whereof he the Said James Harmon doth hereby acknowledge and himself therewith fully Satisfied contented and paid Hath granted bargained Sold released aliened enfeoffed conveyed confirmed and by these presents doth grant bargain Sell release alien enfeoff Convey and Confirm unto the aforesaid David Hopper his heirs and assigns forever, All the following described piece or parcel of Land Situate lying and being formly in Said Jones’s ^hundred but now of Dover hundred county and State aforesaid and no or near the head of Vincents Marsh it being part of the Same Land that Robert Blackshire late of Kent County died Seized and possessed off and is the same or a part of the Same that on the division thereof was allotted to Robert Blackshire the younger as his Share or dividend of his fathers real Estate which Said part to be conveyed is described as follows viz – Beginning at a Stake in the line of land formerly laid off to Jane Blackshire one of the heirs of the Said Robert Blackshire and running from thence with the line of Said Land South fifty five degrees and fifty five minutes west one hundred and forty one perches to a stake thence North forty Seven degrees and one half degrees west Seventy Eight perches and three quarters of a perch thence North thirty one degrees and twenty three minutes west twenty eight perches and one quarter of a Perch North Eighty three degrees East fifty perches, North thirty eight degrees and fifty two minutes East one hundred and twenty two perches and South thirty four degrees East Seventy Six perches and Eight tenths parts of a perch to the place of Beginning Containing and laid out for fifty four acres and one third part of an acre be the Same more or less, Together with all and Singular the houses buildings orchards gardens fields fences woods underwoods timber and trees marshes meadows cripples pastures with the hereditaments and every the appurtenances whatsoever to the Same belonging or in any wise appertaining and the Reversion and Reversions remainder & Remainders rents issues and profits thereof and also all the Estate right title interest property claim and demand whatsoever of him the Said James Harmon of in and unto all and Singular the Lands and premises described aforesaid either in Law or equity or otherwise To Have and To Hold all and Singular the lands and premises hereby granted unto the aforesaid David Hopper his heirs and assigns to the only proper use benefit and behoof of him the Said David Hopper his heirs and assigns forever, and to and for no other use intent or purpose whatsoever And the Said James Harmon the lands and premises aforesaid against himself and his heirs and against all and every person or persons whatsoever now claiming or hereafter to Claim any part thereof from by or under him them or any of them will at all times forever warrant and defend by these presents – In witness whereof the Said James Harmon hath hereunto set his hand and affixed his seal the day and year first above written. Be it Remembered that on the thirteenth day of January in the year of our Lord one thousand eight hundred and twenty nine before me Jacob stout one of the Judges of the court of common Pleas of the State of Delaware James Harmon named in the foregoing Indenture and party thereto came in his proper person and acknowledged the Said Indenture to be his act and Deed and desired that the same might be recorded as Such.
