Will George Nickerson 1759

In the Name of God Amen I George Nickerson of Kent County on Delaware Farmer being sick and weak of Body but by the Blessing of Almighty God of sound and disposing mind and memory do make this my last Will and Testament in manner and form following to Wit

Imprimis I give and bequeath unto my Brother John Nickerson all that tract of Land and plantation whereon I now Dwell purchased by my Father of George Morgan to have and to hold the said tract of Land and plantation unto my said Brother John his heirs and assigns forever I also give and bequeath unto my said Brother John all my Negroes on said plantation Viz: Luash, Filer, Jen, Sal, Rachel and Ben together with all my stock of Horses, Cattle, hoggs sheep with the plantation utensils and whatever else appertains unto the said tract of Land and plantations to have and to hold the said Negroes and stock unto my said brother John his heirs and assigns forever but I hereby order will and direct that my said Brother in considuration of the above Legacies shall give to my Sister Rahamy Marim a horse and side Saddle to be worth twenty pounds.

Item. I give and Bequeath unto my Cousin John Marim Son of Charles and Rahamy Marim all my part of a tract of Land being part of a larger tract called Great pipe Elm to be divided between my said Cousin John and my brother John Nickerson according as directed in my Fathers Will to be divided between myself and sd Brother.Except thereout twelve Acres and one half of woodland out My? part of said Tract of Land to be disposed of as hereafter mentioned to have and to hold the said tract of land (except as before excepted unto my said Cousin John Marim his heirs and Assigns forever, but in case my said Cousin John Marim should die before he come to the age of twenty one years then and in such case I give the said tract of Land (except as before excepted unto my Cousin Elizabeth Marim his Sister to her and her heirs and assigns forever.

Item I give and Bequeath unto my Brother John Nickerson the remaining twelve acres and one half of the last described tract of Land be laid off in the most convenient manner so as to be contiguous to my said Brothers part of said Land to have and to hold the said twelve acres and one half of Land to my Brother his heirs and assigns forever.

Item I give and Bequeath unto my Brother John Nickerson the one half of my Marsh to have and to hold to my said Brother his heirs and assigns forever

Item I give and Bequeath to my Cousin John Marim the other half of my Marsh ^to him his heirs and assigns forever to be equally divided between my said Cousin and Brother John but in case my said Cousin should die before her arrive at the Age of twenty one years then & in such case I give the said one half of my marsh unto my Cousin Elizabeth Marim his Sister her heirs & assigns forever.

Item I give unto my Brother John Nickerson his heirs and assigns Forever my Silver Watch

Item It is my will that my Negroe Woman Phillis shall be free and I hereby manumit and ^set my said Negroe Woman Phillis Free

Lastly The residue of my Estate of what kind or quality soever I give and bequeath unto my Brother John Nickerson and his Brother in Law Charles Marim to be equally divided between them to them their heirs and assigns forever and I hereby  Nominate constitute and appoint my Brother John Nickerson and my Brother in Law Charles Marim to be Executors of this my last Will and Testament hereby revoking all former wills by me heretofore made In Witness whereof I have hereunto set my hand and affist my seal this twenty second day of December in the year of our Lord one thousand seven hundred and fifty nine. The interlineation in the sixth bequest was made before the execution of this Will

Signed Sealed published pronounced and declared by the Testator as his Last Will and Testament in the presence of us James Sykes John Maxwill George Stevens

Personally appeared before me James Sykes and John Maxwell Two of the Subsiding Evidences to the within Will and being duly Sworn do declare that they did see and hear George Nickerson make his mar, Seal, Publish, Pronounce and declare the within Instrument of Writing as his last  Will and Testament, that at the Time of his so doing & saying the same he was (to the Best of their Belief ) of sound and disposing mind and Memory, that they at the same Time Signed their names as Evidences thereto at his request, and that they did see George Stevens Sign his name as one of the Evidence thereunto In Testimoney whereof I have Hereunto Set my Hand this 14th day of febry Ann.
