Will George Dehorty 1806

In the Name of God Amen I George Dehorty of Kent County in the State of Delaware being in a very low state of health But of sound mind memory and Common understanding and Calling to mind that all men is Born to die I do therefore make this my last Will and Testament hereby making all other Wills made by me heretofore Void and null.

Imprimis my will is that my funeral Charges and other Just debts be first paid out of my Personal Esate, Item give and Bequeath to my well beloved wife Nancy Dehorty one Bay horse named figer one negro woman Amy and all four of her Children Samuel Joseph Affee and the young one I now not her hame and one of my Best Beds Chest and one old green dito sic old Rush bottomed Chairs her ???? her first Choice one dining walnut Table one Common pine Table one Bed first Ch[oice] of my Cows her two first Choices of my Iron pots and hooks all my puter t?? E??? And one Sow and pits the Largest Looking Glass in the Little room and all my Ca??? ??? Except my Chancy one inferior bed and remains of my Estate Except what I ??? here after mention Item I give and Bequeath my Large house bible and one silver Table spoon and all my Book account that I have to gether with five pounds in Cash to my Eldest son Absalom Dehorty Item 3 I Give and Bequeath to my son Thomas Dehorty all that Tract or parcel of Land that I purchased of a  Certain George Anderson which Tract of Land he my son Thomas Dehorty now has in possession to be to his own Lawful use to him and his heirs and assigns forever Item I give and Bequeath to my son John Dehorty all that farm where on a Certain Elizabeth Travis now lives together with all the Improvements thereon with all the Timbered Land in the East north and west sides of sd farm and to  a certain line that is to be Rum a Cross the woods Land between the said farm and an other little farm that I have on the same Tract of Land which said little farm a certain Richard Tulet Negro and a Certain Thos. Travis Negro now lives the afore mentioned Line to Begin at the out Line of the original or hole Tract on the East side of sd. Tract and to run on a Straight Corse a Cross the sd. original Tracts to the out line of the sd. Tracts on the west side of sd. Tracts so as to devide the swamp or woods Equilly Between the said little farm and the farm given to my son John Dehorty the said farm let it be more or less to the to the proper use and behofe of him my son John Dehorty to him and his heirs and assigns forever I also Give my son John one horse called labor one Cow one Bed and furniture, Itim I Give and Bequeath to my son Philoman Dehorty my mansion house and plantation with all the Improvements woods and timber thereunto belonging thereunto to be to the proper use and  behofe of him his heirs and assigns forever I also Give him a Colt that my mare polish is now with ???? With the sd. Colt to suck the mother untill ????? I also Give him one Cow and Bed and furniture, Itim I give and Bequeath to my Daughter Ann Dehorty alittle farm on the S. E. end of my Land which little farm a Certain James White now lives including one hundred acres of Land in the hole provided the hundred Acres do not infring ??? ???? in or on the Little farm on which a certain Thos Travers Negro now lives by tuning a Straight line a Cross the said Original Tract but if it should my will is that a loser Quantity be laid off so as to leave a Reasonable Quantity of timber for the support of that part of the sd. little farm where the sd. Thos Travers negro now lives I also Give my Daughter Anna A sorrel horse Colt three years old this Spring one Bed and furniture one ???ing Table a small Cornr walnut Cubbard one young Cow and Six pounds in Cash Item I Give and Bequeath the little farm whereon a Certain Richard Tutel and a Certain Thos. Traves negro man lives together with all the Improvements and  said Land lying between the out lines of my son John Dehortys Lands and my daughter Anna Dehortys Lands to my two young daughters namely Nancy Dehorty and Elisa Dehorty to be Equally divided between them to be to the proper use and behofe of them and their heirs of their bodies Lawfully Begotten but If either of them dye without heir the hole to fall to the other and there heirs and my will further is that my wife Nancy Dehorty and my Son John Dehorty ???????????lidg in my mansion house and other mansion houses my ??????? is that my wife has all the Reasonable Rents of all my Land for ???? ???? she applies it to building and Improving on my two ????? Except the rents of my son Thomas Dehortys Land  for the present year and no longer Except the Land left to my two young Daughters that she is to enjoy during her natural lifetime or widowhood for the purpose of Raising and Schooling Said Children, Item my further is that my son Andrew Dehorty shall have all the rents and profits of tne Land willed to my son Philemon Dehorty and my daughter Anna Dehorty untill they my son Philoman Dehorty and Daughter Anna Dehorty arive to the age of twenty one years of age and when my son Philomon Dehorty arives to the age of twenty one years my will is that he enjoys Gust and full possession of his Lands and also my Daughter Anna Dehorty when she arives to the age of twenty one years that she may injoy Gust and full possession of her Land, Item my will further is that the ballance of my personal Estate be sold at publick sale after the Crop is laid by and give twelve months Credit and the poduct of such sale to be Eaquilly divided Between my Son Andrew Dehorty and my too youngest daughters namly Nancy Dehorty and Elise Dehorty, Item in the ment and last place I do nominate and appoin my wife Nancy Dehorty and my son  John Dehorty Joint Exeter and Executors of this my last Will and Testament signed and sealed this twenty sicond day of March in the year of our Lord one Thousand Eight hundred and Six. State of Delaware Kent County personally appeared before me Nathaniel Smithers Register of Kent County for the probate of Wills &c William Harrington and Vincent Dehorty the Subscribing witnesses to the above and foregoing Instrument of writing and being solemn sworn on the holy Evangels of almighty God do decla[re] that they and Each of them saw George Dehorty Testator above Mentioned Signed and sealed the above and foregoing Instrument of writing that they also heard him publish pronounce and declare the same as and for his last will and Testament that at the time of his so doing and saying he was to the best of their belief of sound disposing mind memory and understanding that they subscribed their names as Witnesses thereto in the presence and at the request of the said Testator and in the presence of Each other In Testimony whereof  I have hereto set my hand the twenty ninth day of September in the year of our Lord one Thousand Eight hundred and Siven Nathl Smithers Recr

Be it remembered that on the twenty ninth day of September in the year  of our Lord one Thousand Eight hundred and Seven the last Will and Testament of George Dehorty decd was Exhibited proved and approved and Letters Testamentary was in due form of Law Granted in said decd Estate to John Dehorty ^one of the Executors in such Testament who being sworn gave Bond with Thomas Dehorty and Absolom Dehorty his suretys in the sum of three Thousand dollars Lawful money for his faithful discharge thereof in hand 

To the Register of Kent County in the State of Delaware for recording wills and Granting Letters of Administration there and to Certify to you that I do hereby refuse my part of the Administration of my husband Estate to my step Son John Dehorty for me Nancy Dehorty her mark  W. State of Delaware Kent County. personally appeared before me Nathaniel Smithers Regr of Kent County afsd. for the probate of Wills &c Vincent Dehorty the subscribing witness to the within Instrument of Writing and  made oath on the holy Evangels of Almighty God that he saw Nancy  Dehorty sign the within Instrument of writing by making her mark and that he also heard her acknowledg the same as her act and deed In Testamony whereof I have hereto set my hand the 29 day of September 1807 Nathaniel Smithers Regr.
