This Indenture made the Sixth day of March in the year of our Lord one thousand eight hundred and fifty two Between William Brinkley of Camden Delaware and Ann his wife and Nathaniel Brinkley of the same place and Sarah Ann his wife (free coloured) of the one part and William H McBride of the same place of the other part. Whereas Ceasar Brinkley (free coloured man) became in his lifetime seized in his demesne as of fee of in & to divers lands tenements and hereditaments situated lying and being in the vicinity of Camden aforesaid and being so thereof seized died intestate leaving to survive him a widow (namely Elizabeth and two only children and heirs at law, to wit the said William and Nathaniel to whom the said lands Tenements and hereditaments did descend and came according to the intestate laws of the state of Delaware. And whereas the said Elizabeth widow of the said Ceasar Brinkley hath also deceased And whereas the said William Brinkley and Ann his wife and the said Nathaniel Brinkley and Sarah Ann his wife are now about to convey for the consideration hereafter mentioned unto the said William H. McBride and his heirs and assigns, All that certain lot or parcel of land situated lying and being near Camden aforesaid Beginning on the South side of a new laid out road at a stake formerly a corner for Jonathan now Hunn Jenkins land and running thence with South thirty nine and three quarter degrees West thirty perches and three tenths of a perch to a stake standing in a line of said Jenkins land and corner of Isaac Dalbys lot thence running therewith North sixty degrees West twenty four perches and two tenth of a perch to a stake for a corner standing on the East side of a road rely laid out an other corner of the said lot of Isaac Dalby thence running with the said road north twenty two degrees and three quarters of a degree East thirty five perches to a corner at the intersection of said road from thence along the first mentioned road South sixty degrees East thirty five perches and two tenths of a perch to the place of Beginning Containing six acres of land more or less And is the same lot or parcel of land which Elias Jarrell by his Indenture bearing date on the twenty seventh day of November One thousand eight hundred thirty seven conveyed to the said Ceasar Brinkley reference to said Indenture being had will fully appear, Now Therefore This Indenture Witnesseth That the said William Brinkley and Ann his wife and the said Nathaniel Brinkley and Sarah Ann his wife for and in consideration of the said sum of Two Hundred and Seventy five Dollars lawful money of the United States of America to them in hand paid at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledged Have granted, bargained and sold, and by these presents do grant, bargain, sell, alien, enfeoff, release, convey and confirm unto the said William H McBride and to his heirs and assigns All the before mentioned and described lot or parcel of land premises with all and singular other the Houses outhouses, buildings, ways, woods, waters water courses, rights, liberties privileges hereditaments and appurtenances whatsoever thereunto belonging or in anywise appertaining and the reversion and reversions remainder and remainders rents issues and profits thereof and all the estate, right, title, claim, demand and possibility of them the said William Brinkley and Ann his wife and him the said Nathaniel Brinkley and Sarah his wife or either of them their heirs or either of their heirs in law or equity or otherwise howsoever of, in, to or out of the same To Have and To Hold the said lot or parcel of six acres of land more or less hereditaments and premises hereby granted or mentioned or intended so to be, with their and every of their appurtenances unto the said William H. McBride his heirs and assigns to the only proper use and behoof of him the said William H McBride his heirs and assigns forever and to and for no other use, intent benefit or behoof whatsoever In Witness Whereof the said William Brinkley and Ann his wife and the said Nathaniel Brinkley and Sarah Ann his wife have hereunto set their respective hands and seals the day and year first herein before written. Be it Remembered that on the Sixth day of March in the year of our Lord one thousand eight hundred and fifty two Before the subscriber Notary Public for said State William Brinkley and Ann his wife and Nathaniel Brinkley and Sarah Ann his wife named in the within and foregoing indenture personally appeared and acknowledged said indenture to be their act and deed respectively and desired that it might be recorded, and that on the same day the said Ann Brinkley wife of the said William Brinkley and the said Sarah Ann Brinkley wife of the said Nathaniel Brinkley being each privately examined by me apart from her husband acknowledged that she executed the said Indenture willingly without compulsion or threats or fear of her husband’s displeasure.
