Deed Ceasor Brinckle N. from John Taylor and Margaret his wife
This Indenture made this fifth day of April in the year of our Lord one thousand Eight hundred and Seventeen. Between John Taylor of Chester County in the State of Pennsylvania and Margarett his wife of the one part and Caesar Brinckle of the Village of Camden Kent County in the State of Delaware of the other part – Whereas John Edmonson late of said County of Kent in the Said State of Delaware (Father of the Said Margarett Taylor) was in his lifetime and at the time of his Death Lawfully Seized and possessed of and in a certain Tract or parcel of land Situate lying ad being in Murderkill hundred Kent County and State of Delaware near or adjoining to the Said village of Camden and being to therof seized and possessed of and in said Tract or parcel of land died intestate leaving a widow now the wife of Isaac Taylor of said Chester County in the State of Pennsylvania and two Daughters the aforesaid Margarett Taylor and Eliza now the wife of George Batten of said Chester County in the Said State of Pennsylvania his heirs and legal representatives and whereas by virtue of an order of the orphans Court of the State of Delaware held at Dover for Kent County aforesaid the said Tract or parcel of Land whereof the said John Edmondson died Seized and possessed as aforesaid has since been divided among his said legal heirs and Representatives and said division has since been Confirmed by the Said orphans Court and the Said John Taylor and Margarett his wife have Since divided their share or dividend of said Tract or parcel of Land into small parts or lots of ground and sold the same to sundry persons and they the said John Taylor and Margarett his wife being now about to make over and convey unto the said Caesar Brinckle and his heirs and assigns all the following described Lot of Ground being part of the Share or Dividend of the Said Margarett Taylor of and in the Said Tract or parcel of land whereof her father died Seized and possessed as aforesaid therefore this Indenture, witnessed that the Said John Taylor and Margarett his wife for and in Consideration of the Just and full Sum of one hundred and ninety Dollars lawful money of the united States of America to them in hand paid by the Said Ceasor Brinckle the receipt whereof they the Said John Taylor and Margarett his wife herby acknowledge and themselves therwith fully satisfied contented and paid have granted Bargained and sold Released aliened enfeoffed and Confirmes and by these presents do Grant Bargain Sell release alien enfeoff Convey and Confirm unto the Said Caesor Brinckle and his heirs and assigns as tenant in Common all the following described lot of ground being part of the Said John Taylor and Margarett his wifes share or dividend of the Tract or parcel of Land wherof the said John Edmondson died Seized and possessed as aforesaid and by a plot of Said Share or Dividend made by Gideon Cullen Surveyor for John Taylor and Margarett his wife is marked number Sixteen Beginning at a corner of Thomas Howells land in the middle of the State road and running there with south Thirty nine and three fourths degrees West Thirteen and one tenth perches to a corner of number Seventeen thence there with north fifty two and three fourths degrees west forty eight and nine tenths perches to a Corner in a line number fifteen thence therewith north thirty Six degrees east Seventeen perches to a corner in Said Howells line thence therewith South forty eight degrees East fifty perches to the Beginning Containing four acres and Twenty Square perches (a cleared Land lot) be the Same more or less – Together with all and Singular the fences with the emoluments hereditaments ad appurtenances whatsoever to the Said Lot of ground Belonging or in anywise appertaining and the reversion and reversions remainder and remainders rents issues and profits thereof with all the estate right Title interest property claim and demand whatsoever as well in law as in equity of them the Said John Taylor and Margarett his wife of in and unto the Said Lot of ground & premises to Have and To Hold the Said lot of ground and premises with the appurtenances thereunto belonging herby granted, bargained and Sold to the Said Ceasor Brinckle and his heirs & assigns to the only proper us benefit and behoof of him the Said Ceasor Brinckle his heirs and assigns Forever and the Said John Taylor and Margarett his wife and their and each of their heirs the Said hereinbefore described Lot or parcel of ground herby Granted bargained and Sold to the Said Caesor Brinckle his heirs and assigns as aforesaid against themselves the Said John Taylor and Margarett his wife and their and each of their heirs and against all and every other person or persons now lawfully Claiming or hereafter to Claim the same or any part or parcel thereof by favor or under them or either of them Shall and will Warrant and forever defend by these presents -In witness whereof the Said John Taylor & Margarett his wife have hereunto set their hands and affixed their seals the day and year thereinbefore written. Kent County State of Delaware Sst } Be it Remembered that on this fifth day of April in the year of our Lord one thousand eight hundred and Seventeen John Taylor and Margarett his wife the grantors in the foregoing Indenture named personally came before me William Warner one of the Justices of the Court of Common pleas for the Sate of Delaware afsd. and acknowledge the Same to be their act and Deed respectively and the said Margarett being examined by me apart from her husband and out of his hearing did declare that She became a party to the same of her own free will and was not Induced thereto by threats ill usage or fear of Incuring the displeasure of her husband in witness therof I have hereunto Set my hand the day and year above Written William Warner J.
