Deed of Mortgage Ferman S. Turner to William Ryan 1882

This Indenture made (in duplicate) the Seventeenth day of January one thousand eight hundred and eighty two. In pursuance of an act respecting Short Forms of Mortgages. Between Ferman S. Turner of the Town of Chatham in the County of Kent an unmarried man one of the heirs-at-law of Jeremiah S. Turner late of the Township of Camden in the said County of Kent deceased hereinafter called the mortgager of the first part and William Ryan of the Town of Chatham in the County of Kent Gentleman hereinafter called the mortgagee of the second part, Witnesseth that in consideration of One hundred dollars of lawful money of Canada now paid by the said mortgagee to the said mortgager (the receipt whereof is hereby acknowledged, He the said mortgager Do Grant and mortgage unto the said mortgagee his heirs an as- signs forever.

All and Singular these certain parcels or tracts of land and premises situate lying and being in the Township of Camden in the County of Kent in the Province of Ontario. Being composed of all those parts of Lots number One in the Sixth and Seventh Concession of said Township of Camden conveyed by Julia Ann Shadd and others to the said Jeremiah S. Turner By Indenture dated the 19th day of October A.D. 1858 and registered in the Registry Office for the County of Kent on the 11th day of February A.D. 1859 in Liber B Folio 131 no 92. Provided this mortgage to be void on payment of One hundred dollars of lawful money of Canada with interest to Twelve per cent per annum as follows.  Per one year from the date hereof with interest at the rate aforesaid and taxes and performance of Statutory labour the said mortgager covenants with the said mortgagee that the mortgager will pay the mortgage money and interest and observe the above proviso, That the mortgager hath a good title in fee simple to the said lands. And that he hath the right to convey the said lands to the said Mortgagee. And that on default of the mortgage shall have quiet possession of the said lands free from all incumbrances. And that the said mortgager will execute such further assurances of the said lands as may be required. And that the said mortgager hath done no act to encumber the said lands. And that the said mortgager will Secure the Buildings on the said lands to the amount of not less than __ currency. And the said mortgager Do Release to the said mortgagee all his claim upon the said lands subject to the said proviso. Provided that the said mortgagee in default of payment for one month may giving one weeks notice enter on and lease or sell the said lands. Provided that the mortgagee may distrain for arrears of interest. Provided that in default of the payment of the interest hereby secured the principal hereby secured shall become payable. Provided that until default of payment the mortgager shall have quiet possession of the said lands. In Witness Wherein the said parties hereto have hereunto set their hands and Seals. sd. Firman S. Received on the day of the date of this Indenture from the mortgagee the sum of One hundred dollars being the full Consideration therein mentioned. Witness sd. James Warren sd. Firman S Turner

I James Warren of the Town of Chatham in the County of Kent, Esquire make oath and say That I was personally Present and did see the within Instrument and Duplicate duly signed sealed and executed by Firman S. Turner one of the parties thereto. 2. That the said Instrument and Duplicate were executed at the said Town of Chatham. 3. That I know the said parties. 4. That I am a subscribing witness to the said Instrument and Duplicate.
