This Indenture made this second day of March in the year of our Lord one thousand eight hundred and fifty eight between James C. Bird, M.D. of the town of Dover in Kent County and State of Delaware and Caroline his wife of the one part, and Moses America, the younger, bouldered man, of the County aforesaid of the other part. Witnesseth that the said James C. Bird and Caroline his wife, for and in consideration of the sum of one Hundred Dollars lawful money of the united States of america to them in hand paid by the Moses America at or before the sealing and delivery hereof the receipt whereof is hereby acknowledged, Have and each of them Hath granted bargained and sold, aliened enfeoffed released conveyed and confirmed and by these presents Do, and each of them Doth grant bargain and sell, alien enfeoff, release convey and confirm unto the said Moses America the younger heirs and assigns, all that certain lot, piece or parcel of ground situated in the town of Dover in Dover Hundred Kent County and State of Delaware bounded as follows, viz; Beginning on Queen Street at the distance of fifty feet from the corner thereof (at the southern edge of Division Street, and at a corner of a lot conveyed by Joseph P. Comegys and wife to Anna Maria Morris, and running from thence at right angles with said Queen Street along the line of said Morris’ lot, south seventy eight degrees and fifteen minutes, west one hundred and fifty feet to a corner thence south eleven degrees and forty five minutes the distance of fifty feet and parallel to said Queen Street to a nother corner, thence north seventy eight degrees and fifteen minutes East, parallel to the line first mentioned, the distance of one hundred and fifty feet, to Queen Street aforesaid thence along the western edge of said Queen Street north eleven degrees and forty five minutes west, the distance of fifty feet to the place of Beginning Containing Seven Thousand and Five Hundred Superficial feet of ground, more or less: Together with all and singular the buildings fixtures and improvements woods, ways, waters and water courses, ways, alleys passages, easements, profits, commodities hereditaments and appertenances thereunto belonging or in any wise appertaining and the reversions and remainders unto issues and profits thereof, and also all the estate right, title, property, interest, claim and demand of them the said James C Bird and Caroline his wife, and of each of hem, of in and to the same, and every part there of, either at law or in equity. To Have and To Hold the lands tenements hereditaments and premises hereby bargained and sold, or mentioned and intended so to be, with the appurtenances unto the said Moses America the younger, his heirs and assigns, to and for the only proper use benefit and behoof of him the said Moses America, the younger, his heirs and Assigns forever. In witness where of the said James C. Bird and Caroline his wife, have hereunto set their respective hands and seals the day and year first herein written. The lot of ground herby conveyed is that first described in the deed of Joseph P. Comegys and wife to the said James C. Bird dated the first day of December A.D. 1855 James C. Bird {seal} Caroline W. Received on the day of the date of the foregoing Indenture from Moses America, the younger the granted therein named the sum of one hundred dollars, being in full of the consideration money therein mentioned Witness, Saml Culbreth
The State of Delaware Kent County. ss. Be it remembered that on this second day ofMarch A.D. 1858 personally came before me, Samuel M Harrington Chancellor of the State of Delaware James C. Bird and Caroline his wife, parties to this Indenture, Known to me personally to be such, and severally acknowledged this Indenture to be their deed, and that the said Caroline Bird being at the same time privately examined by me apart from her husband, acknowledged that she executed the said Indenture willingly without compulsion or threats or fear of her husbands displeasure.
