This Indenture made this seventeenth day February in the year of our Lord one Thousand eight hundred and Forty nine between Zachariah Johnson (n) of Little Creek Hundred Kent County and state of Delaware and Amy his wife of the one part and Isaac Miller (n) of the same place of the other part Witnesseth that the said Zachariah Johns and Amy his wife for and in consideration of the sum of Three hundred Dollars lawful money of the state of Delaware to them in hand paid by the said Isaac Miller on or before the sealing and delivering of these presents the receipt whereof they the said Zachariah Johns and Amy his wife doth hereby acknowledge and thereof acquit and forever discharge the said Isaac Miller his heirs Executors and administrators by these presents have granted bargained sold aliened enfeoffed and confirmed and by these presents do grant bargain sell alien enfeoff release and confirm unto the said Isaac Miller and to his heirs and assigns all that certain tract piece or parcel of Land situated lying and being in Little Creek Hundred County and state aforesaid and on the North west side of the road leading from Dennys Corner to the town of Leipsic & being a part of the lands and premises formerly of Philip Denny (deceased) and a part of that part thereof which was aloaed and assigned to Mary Denny his widow as and for her Dower and confirmed by the Orphans Court at the August term in the year one Thousand Eight Hundred and twenty one which said Dower has by sundry consequences become the right and property of the said Zachariah Johns and the part now conveyed is from a survey made thereon set fourth and discribed with the following metes and bounds To Wit, Beginning at a stone and stump of the old Corner white oak of William Hillers heirs a small white oak sapplen now marked standing by it on the south side a small beach called Wilsons beach on the brow of the hill and running from thence along the line of said Hillers heirs south Eighteen Degrees and one half of a Degree East Thirty perches and one quarter of a perch to a stake on high ground for the old corner Spanish oak down and gone still with the line of the last mentioned Land, and the out line of the whole premises south Forty one Degrees East five perches to the middle of the road Leading from Dennys Corner to the town of Leipsic corner for the remaining part of said dower Thence down the middle of said road and binding therewith North seventy seven Degrees and one quarter of a Degree East fifty Perches to a turn thereof still with said road North twelve Degrees West six perches to the run or water course of said small branch called Wilsons branch then up the same, and bending with the water course thereof about Thirty nine perches and one half of a perch thence south Eighteen degrees and one half of a degree East six perches to the place of Beginning Containing one hundred fort five Acres and one hundred and fourteen square perches of high land and branch meadow on the said Wilsons branch be the same more or less together with all and singular the Fixtures and improvements woods ways water and wear courses rights privelidges heraditaments and every the appertenances thereunto belonging or in any wise appertaining with the reversions and remainders yearly and other rents and issued and profits thereof to have and to hold the herein before described piece or parcel of Land and every part and parcel thereof to him the said Isaac Miller his heirs and assigns to the only proper use benefit and behoof of him the said Isaac Miller his heirs and assigns Forever and the said Zachariah Johns and amy his wife the said piece or parcel of Land aforsaid with the appertenances against themselves their heirs and assigns all and every other person or persons now Claiming or hereafter to claim the same by from or under him them or any or Either of them shall and will forever hereafter warrant and defend by these presents In Witness whereof the said Zachariah Johnson and Amy his wife hath hereunto Seth their hands and seals the day ad year first above written. Received the day and date of the within Indenture from Isaac Miller Three hundred Dollars in full for the consideration here mentioned $300 Zachariah Johnson his mark

Bates Daniel Smith The state of Delaware Ss Be it remembered that on the 17th day of February AD 1849 Zachariah Johns and Amy his wife parties to this Indenture personally came before the subscribers an apointed Judge of the state of Delaware and severally acknowledged the same to be their act and deed respectively And the said Amy at the same time being privately Examined by me apart from her husband acknowledged that she enacted the said indenture willingly & without compulsion or threats of force of her husband displeasure Given undermy hand the day and year aforesaid I.M.
