Deed from Henry Viney & wife To Elijah Viney
This Indenture made this 4th day of June in the year of our Lord one Thousand eight Hundred and fifty nine Between Henry Viney and Elizabeth his wife of the first part of New Jersey and Elijah Viney of Duck Creek Hundred Kent County and State of Delaware of the second part Witnesseth that the said Henry Viney and wife for and in Consideration of the sum of Twenty Dollars lawful money of the United States of America to them in hand paid by the said Elijah Viney on or before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged Have and each of them Hath granted bargained and sold aliened, enfeoffed released conveyed and confirmed and by these presents Do and eat of them Doth grant bargain and sell alien enfeoff release convey and Confirm unto the said Elijah Viney his heirs and assigns All That Certain lot peice or parcel of land situated in Duck Creek Hundred the metes bounds Courses and distances whereof are as Follows “To wit” All and singular the undivided shear or several part of him the said Henry Viney of, in and to that small peice or Tract of land situated in Duck Creek Hundred Kent County and State of Delaware aforesaid adjoining lands of Isaac Sutton and Isaac Register and containing about eight acres in the whole Being the same Tract which was conveyed by deed of bargain and sale from Joshua Brown and wife to John Viney the Elder now deceased the father of the parties hereto now of record in the proper office at Dover in Book 2 vol 3 for 61 &c and the same tract of wich said John Viney the Elder decd seised And All and Singular the Buildings fixtures, ways woods waters watercourses easements improvements hereditements privileges and appurtenances to the said lot peice parcel or tract of land Belonging or in anywise appertaining and the Reversion and Reversions Remainder and Remainders Revisions and profits thereof And all the estate right title interest property claim and demand of them the said Henry Viney and Elizabeth his wife at law or in equity of to in or out of the same and every part and parcel thereof “To Have and To Hold the land and premises hereby bargained and sold or intended to be with the appurtenances unto the said Elijah Viney his heirs and assigns To and for the only proper use benefit and Behoof of him the said Elijah Viney his Heirs and Assigns Forever.
And the said Henry Viney and Elizabeth his wife for themselves their heirs executors and administrators do hereby further grant Covenant and agree to and with the said Elijah Viney his heirs and assigns That the land and premises hereby bargained and sold or intended to Be with the appurtenances against them the said Henry Viney and Elizabeth his wife their heirs executors and administrators and against all persons claiming or lawfully to Claim by through from or under them unto the said Elijah Viney his heirs and assigns They the said Henry Viney and Elizabeth his wife Shall and will warrant and Forever Defend”.

State of Delaware Kent County SS. Be it Remembered That on this first day of June in the year of our Lord one Thousand eight Hundred and Fifty nine personally came before me Ezekiel W. Reed a Notary Public for the State of Del. Henry Viney and Elizabeth his wife parties to this Inden=ture known to me personally to be such and severally acknowledged this Indenture to be their aced “ And the said Elizabeth Viney being at the same time privately examined by me apart from his Husband acknowledged that she executed the said Indenture willingly without compulsion or threats or fear of her Husbands displeasure”
