This Indenture made this third day of August in the year of our Lord One Thousand Seven Hundred and Seventy eight by Between Eleanor Montgomery of Mispillion Hundred in Kent County afsd widow of the one Part, and William Montgomery son of the afsd Eleanor Montgomery of the other Part. Whereas a Marriage is intended Shortly to be had and Solemnized between the said Eleanor Montgomery and a Certain Abner Dill of Kent County afsd Taylor and whereas the Conveyance of the Land and negro herein after to be mentioned by the said Eleanor Montgomery to the sad William Montgomery was made by an with the Privity and Consent of the said Abner Dill before any Solemnization of Marriage had between them. Now this Indenture witnessed that the said Eleanor Montgomery as well for and in Consideration of the natural Love and Affection which she hath and bearers to the said William Montgomery and for his better maintainance and Livelyhood as also for and in Consideration of the Sum of Five Shillings to her the said Eleanor Montgomery in hand paid by the said William Montgomery by these presents hath given granted bargained and Sold aliened enfeoffed Conveyed and Confirmed, and by these presents doth give grant bargain and Sell alien Enfeoff convey and Confirm unto the said William Montgomery his heirs and assigns forever, Fifty Acres of Land to be Laid Off for the said William Montgomery out of a Tract or parcel of land Called my Delight Situate lying and being in Kent County afsd which said Fifty Acres of Land the said Eleanor Montgomery is to lay off for the said William Montgomery by metes and bounds at the Reasonable request of the said William Montgomery, and also one negro Woman Slave named Amynta, and all the Estate Right Interest Property Claim and Demand whatsoever of her the said Eleanor Montgomery of in and to the afsd Fifty Acres of Land herein above mentioned to be bargained and Sold, and every part and Parcel thereof with every of its Improvements and Appurtenances, and of in and to the aforesaid negro woman Slave herein above mentioned to be granted and the Reversion and Reversions Remainder and Remainders Rents and Services of the aforesaid Fifty Acres of Land and Premises hereby Granted with every of its Appurtenances, To Have & to Hold all and Singular the afsd. hereby Granted Land & Premises and the aforesaid Negro woman Slave named Amynta unto the said William Montgomery his Heirs and Assigns forever to his and their Sole an Proper uses forever and to no other use Intent or Purpose whatsoever and the said Eleanor Montgomery for herself her Heirs Executors and Administrators do the Covenant Grant an agree to and with the said William Montgomery his heirs and Assigns by these presents that she the said Eleanor Montgomery an her heirs the afsd Fifty Acres of Land with every of its Appurtenances and the aforesaid negro woman Slave called Amynta herein above mentioned to be Granted unto him the said William Montgomery and his heirs and Assigns against her the said Eleanor Montgomery and her heirs and against all & every Person and Persons claiming by from or under her or her heirs or any of them shall an will warrant and forever by these Presents defend, In Witness whereof the said Eleanor Montgomery hath hereunto set her hand and Seal the Day and year first above written. Be it Remembered that Jonathan Morgan one of the Subscribing Witnesses to the within Deed Came into the Court of Common Pleas held at Dover and for Kent County on Delaware ye thirteenth day of August in the Year of our Lord One Thousand Seven Hundred and Seventy eight, and made oath on the Holy Evangelists of Almighty God, that he saw Eleanor Montgomery Sign seal duly Execute and deliver the within Deed unto William Montgomery with the Lands and Premises, therein Specified to be her Right & Property according to the Purport and Effect thereof and that he Subscribed his name thereto as a witness and at the same time saw William Owens and William Ross Sign as two other Witnesses thereto In Testimony whereof I have caused the Public Seal of Kent County aforesaid to be hereunto affixed.
