Transfer of Slaves Flora and Chloe by Eleanor Montgomery to Ann Montgomery 1778

This Indenture made this Third day of August in the Year of our Lord One Thousand Seven Hundred and Seventy eight by and Between Eleanor Montgomery of Mispillion Hundred in Kent County on Delaware widow of the one Part and Anne Montgomery of the same County daughter of the said Eleanor Montgomery of the other part: Whereas a marriage is intended Shortly to be had and Solemnized between the said Eleanor Montgomery and a Certain Abner Dill of the County aforesaid Taylor And whereas the Conveyance of the negro Slaves herein after mentioned by the said Eleanor Montgomery to the sad Anne Montgomery was made by and with the Privity and Consent of the said Abner Dill before any Solemnization of marriage was had between them Now this Indenture witnesseth that the said Eleanor Montgomery as well for and in Consideration of the Natural Love and Affection which she hath and bearers to the said Anne Montgomery and for her better maintainance and Liveyhood, as also for and in Consideration of the Sum of Five Shillings to the said Eleanor Montgomery in hand paid by the said Anne Montgomery by these Presents hath Given Granted Bargained and Sold Conveyed and Confirmed and by these Presents doth give Grant bargain Sell Convey and Confirm unto the said Anne Montgomery her Executors Administrators and Assigns Forever One Negro Woman Slave called Flora and her child called Cloe and also all the Estate Right Title, Interest Property claim and demand whatsoever of her the said Eleanor Montgomery of in and to the afsd Negro Slaves Flora and Cloe To have and to Hold the aforesaid Negro Slaves Flora and Cloe unto the said Anne Montgomery her Executors Administrators and Assigns forever to her and their Sole & Proper uses forever and to no other use Intent or Purpose whatsoever And the said Eleanor Montgomery for her self her heirs Executors & Administrators by these presents doth Covenant Grant and agree to and with the said Anne Montgomery her Executors Administrators and Assigns that she the said Eleanor Montgomery and her heirs the afsd Negro Slaves Flora and Cloe herein above mentioned to be granted unto the said Anne Montgomery and her Executors and Administrators & Assigns against her the said Eleanor Montgomery and her heirs and against all and every Person and Persons Claiming by from or under her or her heirs or any of them Shall and will warrant and by these presents Defend, In Witness whereof the said Eleanor Montgomery hath hereunto Set her hand and Seal the day and Year afsd. Kent County Ss. Be it Remembered That Jonathan Morgan one of the Subscribing Witnesses to the within Deed came into the Court of Common Pleas held at Dover in and for Kent County on Delaware the thirteenth day of August in the Year of our Lord One Thousand Seven Hundred and Seventy eight and then and there made Oath on the Holy Evangelists of Almighty God That he saw Eleanor Montgomery Sign Seal duly Execute and deliver the within deed unto Anne Montgomery with the Lands and Premises therein Specified to be her Right and Propery according to the Purport and Effect thereof and that he Subscribed his name thereto as a witness and at the same time saw William Owens and William Ross Sign as two other Witnesses thereto. In Testimony whereof I have caused the Public Seal of Kent County aforesaid to be hereunto Affixed— James Sykes Prothy.
