This Indenture made the Fifth day of April in the year of our Lord one thousand eight hundred and thirty two, Between Jacob Morgan of the City of Wilmington in the State of Delaware and Henrietta his wife of the one part, and Abraham D. Shadd, Elijah Turner, and Nathaniel Robinson, Trustees of the African benevolent Association in Wilmington of the other part Witnesseth, That the said Jacob Morgan and Henrietta his wife, for and in consideration of the sum of one hundred and thirty eight dollars to them in hand paid by the said Abraham D. Shadd, Elijah Turner and Nathaniel Robinson at and before the unsealing and delivering hereof, the receipt whereof they do hereby acknowledge, have granted, bargained sold, aliened, enfeoffed released and confirmed, and by these presen[ts] do grant, bargain, sell, alien, enfeoff, release and confirm unto the said Abraham D. Shadd, Elijah Turner and Nathaniel Robinson, and to the Survivors and Survivor of them and to the executors, administrators and assigns of such survivor for the uses and trusts herein after mentioned All that Lot or piece of Land situate in the City of Wilmington aforesaid bounded and described as follows to wit Beginning at a stake standing in the Southerly side of High Street at Eighty two feet six inches broad, and at the distance of forty eight feet, four and an half inches from the Westerly side of Walnut Street at sixty five feet six inches broad, thence along the said side of High Street North fifty eight degrees West twenty three feet to a stake, thence South fifty eight degrees East twenty three feet to a stake thence North thirty two degrees East sixty two feet six inches to the place of beginning, be the Content thereof more or less (It being part of a larger Lot which James Tilton by indenture under his hand and Seal bearing date the twenty fifth day of February 1804 did for the consideration therein mentioned grant and confirm unto the said Jacob Morgan and to his heirs and assigns, as in and by the said Indenture recorded in the Rolls Office at NewCastle, in and for the County of New Castle in Book E volume 4th Page 148 &c at large appears) Together with all and singular other the houses, out houses, buildings, improvements, ways, waters, water courses, rights, liberties, privileges, hereditaments and appurtenances whatsoever thereunto belonging or in any wise appertaining, and the reversions and remainders, rents, issues and profits thereof: and also all the estate, right, title, interest, property, claim and demand whatsoever, of them, the said Jacob Morgan and Henrietta his wife in law or equity, or otherwise howsoever, of, in, to, or out of the same. To have and to hold the said Lot or piece of Land Hereditaments and premises, hereby granted, or mentioned or intended so to be, with the appurtenances unto the said Abraham D. Shadd, Elijah Turner and Nathaniel Robinson and to the Survivors and Survivor of them and to the executors, administrators and assigns of such Survivor. In Trust Nevertheless for the sole use and benefit of an institution in Wilmington, known by the name of “The African benevolent Association” and upon this further trust, absolutely to dispose of and convey the same either in fee, or for such other estate and in such way and manner as the said Association shall at any time order direct and appoint. And the said Jacob Morgan, for himself, his heirs, Executors and Administrators doth, covenant promise, grant and agree to and with the said Abraham D. Shadd Elijah Turner and Nathaniel Robinson and the Survivors and Survivor of them, by these presents, that he the said Jacob Morgan and his heirs the said above mentioned and described Lot or piece of Land, hereitaments and premises, hereby granted or mentioned ^or intended so to be, with the appurtenances unto the said Abraham D. Shadd, Elijah Turner and Nathaniel Robinson and the survivors and survivor of them and to the heirs executors, Administrators and Assigns of such survivor against him the said Jacob Morgan and his heirs, and against all and every other person and persons whomsoever lawfully claims or to claim, by from or under him, them or any of them, shall and will warrant and forever defend, by these presents In Witness whereof the said Jacob Morgan and Henrietta his wife have hereunto set their hands and seals the day and year first above written. State of Delaware City of Wilmington Ss.Be it remembered that on the fifth day of April in the year of our Lord one thousand eight hundred and thirty two, before the subscriber, Mayor of the said City of Wilmington, Jacob Morgan and Henrietta Morgan his wife named in this Indenture personally appeared and acknowledged said Indenture to be their act and deed respectively and desired that it might be recorded, And that on the same day the said Henrietta Morgan wife of the said Jacob Morgan, being privately examined by me apart from her husband acknowledged that she executed the said Indenture willingly without compulsion, or threats, or fear of her husbands displeasure.
