Deed Charles and Elizabeth Cahoon to Robert Derry 1784

This Indenture made the Sixth day of May in the year of our Lord one thousand Seven Hundred eighty and Four Between Charles Cahoon of Kent County and Delaware State yeoman and Elizabeth his wife of the one part and Robert Derry free Negroe of the Hundred and State afsd. Of the other part Witnesseth that the afsd. Charles Cahoon and Elizabeth his wife for & in consideration of the sum of twenty five pounds Lawful money to them in hand paid or Caused so ^to have be by the said Robert Derry the receipt whereof the said Charles Cahoon and Elizabeth his wife do hereby acknowledge and thereof do acquit and forever discharge the said Robert Derry his heirs Executors and administrators fully and absolutely by these presents Have Given Granted bargained and Sold aliened enfeoffed, conveyed and Confirmed and by these presents do Give grant Bargain and Sell alien enfeoff, convey and confirm unto the said Robert Derry his heirs and assigns for ever all that Lott of Ground situate lying and being in Duck Creek Cross Roads in the Hundred and County of Kent aforesaid and in the Delaware State and whereon the said Robert now Dwells, being the Dividend of the aforesaid Charles Cahoon of a Certain Lot (late the property of a Certain Nancy Gibbs deceased) agreeable to the division thereof made, by order of the orphans Court and Contained within the Metes and Bounds – following, that is to say Beginning at a Stone Corner of the Whole of the Lott, late the property of the afsd Nancy Gibbs and Finwick Fishers Land standing in John Darrachs line then with said Fishers Line South eight three Degrees and two thirds of a Degree West nine Perches to a Stone and north twenty nine Degrees and one third of a Degree West Five perches and two tenths of a perch to a Corner of Thomas Cahoons Dividend of the afsd. Lott late the Property of the afsd. Nancy Gibbs then with the line of the said Thos. Cahoons Dividend, across the whole premises North eighty three Degrees and two thirds of a Degree East eleven perches and four tenths of a perch to the Corner of said dividend, in John Derracks lines then with said Darracks line south two Degrees and one third of a Degree East four perches and nine tenths of a perch to the Beginning containing Forty nine Square perches and also all the estate Right title Interest Claim or Demand whatsoever of them the said Charles Cahoon and Elizabeth his wife of in or unto the aforesaid Lott of Ground hereby bargained and Sold or intended so to be with the appurtenances thereunto belonging or in anywise appertaining and the reversion and reversions Remainder and remainders rents Issues and profits thereof To Have and to Hold the aforesaid Lott of Ground hereby granted bargained and Sold with all and Singular the appurtenances thereunto Belonging or in anywise appertaining unto the said Robert Derry His heirs and assigns for ever to his and their only sole use and Behoof forever and to no other use intent or purpose whatsoever and the aforesaid Charles Cahoon and Elizabeth his wife do hereby covenant grant and agree to and with the said Robert Derry his heirs and assigns that they the said Charles Cahoon and Elizabeth his wife the aforesaid Lott of Ground hereby bargained and sold and every part and parcel thereof unto him the said Robert Derry his heirs and assigns from and against them the said Charles Cahoon and Elizabeth his wife and from and against all persons that Claim or shall Claim by from or under them or either of them and from and against all persons Claiming or that shall Claim by from or under the aforesaid Nancey Gibbs shall and will Warrant and by these presents for ever Defend – and lastly the aforesaid Charles Cahoon & Elizabeth his wife do hereby nominate and appoint Richard Bassett Esquire of the Town of Dover to be the attorney of them the said Charles Cahoon & Elizabeth his wife for them the said Constituents and in their name to acknowledge this Indenture in open Court of Common pleas to be held for the County of Kent according to the direction of the act of General Assembly of this State in such Case made and provided. Be it Remembered that on the 6 day of May Seventeen Hundred & Eighty Four Elizabeth the wife of the within Named Charles Cahoon came before me the Subscriber one of the Judges of the Court of Common Pleas in and for the County of Kent in the Delaware State being Privately examined in the absence of her Husband Acknowledged she became a party to the within Deed of her own free Vollentary Will without being thereunto Compelled by her said Husband by threats or fear thereof. Delaware State Kent County sst. Be it Remembered that Richard Smith Esqr. One of the subscribing Witnesses to the within Deed Came into the Court of Common pleas Held at Dover in and for the County afsd. The Twelfth day of May anno Domini Seventeen Hundred and Eighty Four and then and there made oath that he saw Charles Cahoon & Elizabeth his wife (parties to said Deed) Sign Seal and Deliver the within Deed and power of attorney for the uses and purposes therein Mentoned & that he subscribed his name thereto as a Witness and at the same time saw Sarah Poon subscribe her name as one other Witness to the same Whereupon came Richard Bassett Esqr. into the same Court and by Virtue of the power and authority unto him Given then an there did acknowledge the within Deed unto Robert Derry with the Lands and premises therein Specified to be his right and property according to the purport and effect thereof In Testimony I have Caused the Publick Seal of Kent County afsd. to be hereunto affixed.
