Jacob Vining
I Jacob Vining of the Town of Dover Kent County and State of Delaware, do on this nineteenth day of February in the year of our Lord one Thousand Eight Hundred and Sixty three make and publish this my last will and Testament as follows, that is to say,
First, I direct that my body shall be decently buried, and the Expenses thereof, together with my just debts be punctually paid out of my Estate,
Second, I give devise and bequeath the House, lot and garden which I purchased of Martin W. Bates and now hold, Situate in Dover aforesaid, adjoining to lands of James M. Kerbin lands of Said Martin W. Bates and other lands, to Anna Maria White Daughter of Elizabeth White, (better known as Betsy White) late of Dover aforesaid deceased. To Have and to hold the said House lot and Garden, with the appurtenances to her, the Said Anna Maria White and the heirs of her body, to and for their own use forever, If the Said Anna Maria White Shall die without Issue, in that event, I give the Said House, lot and Garden, to the children of my brothers and Sisters, Equally to be divided between them; their heirs and assigns, Share and Share alike.
Third, I hereby give and bequeath all the rest and residue of my Estate of every description which I now have or hereafter may acquire to the Said Anna Maria White her heirs and assigns forever.
Lastly I nominate Constitute and appoint the Said Anna Maria White Executrix of this my last will And Testament, hereby revoking and annulling all wills by me heretofore made and declaring this only to be my last Will and Testament.
In witness whereof I have hereunto Set my hand and Seal the day and year first herein written, Jacob Vining his mark {seal}
Signed Sealed delivered and published by the Said Jacob Vining as and for his last will and Testament, in presence of us who have subscribed the same as witnesses in his presence and at his request. Jos McGorrigal M.B. Hillyard
State of Delaware Kent County SS: Joshua McGerrigal one of the witnesses to the within and foregoing Instrument of writing purporting to be the last will and Testament of Jacob Vining Deceased late of Dover Hundred comes before Moses Harrington Reg of wills in and for Kent County and makes Solemn oath that he saw the Said Testater Sign and Seal the Said instrument and heard him publish pronounce and declare the same as and for his last will and Testament. That at the time of so doing and saying he was of Sound disposing mind memory and understanding and upwards of Twenty one years of age. That he subscribed the same as witness at the instance and in the presence of the Testator and in the presence of M. B. Hillyard the other Subscribing witness who also subscribed the Same in presence of this deponent.
Subscribed and Sworn this the 3d day of October AD 1871 Before} Jas McGorrigal. M Harrington Reg
Be it Remembered that on this 3d day of October AD 1871 the last will and Testament of Jacob Vining Deceased late of Dover Hundred having been proved and allowed of which the above and foregoing is a tru copy. Letters Testamentary therein were in Due form of law granted unto Anna Maria White the Executrix therein named who was Sworn and gave Bond with M. B. Hillyard as surety in the Penal Sum of Two Hundred Dollars See Bond Book No 9 folio 19 Warrant of Appraisement was Issued To William M Jester and M Harrington Reg.
