Deed Matthew Draper to Thomas Pearson and Wife 1865

Deed, Thomas Pearson and, wife, To, Matthew Draper (N) Stamps 50 cts

This Indenture, Made the Twelfth day of September in the year of our Lord one thousand eight hundred and sixty five. Between Thomas Pearson of Dover Hundred Kent County and State of Delaware, farmer and Rachel his wife of the one part; and Matthew Draper, negro, of the same Hundred, County and State of the other part.

Witnesseth: That the said Thomas Pearson and Rachel his wife for and in consideration of the sum of Fifty Dollars Lawful Money of the United States of America, to them in hand paid by the said Matthew Draper, negro, at or before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged, Have and each of them Hath granted, bargained, and sold, aliened, infeoffed, released, conveyed and confirmed, and by these presents Do, and each of them Doth grant, bargain and sell, alien, enfeoff, release convey and confirm unto the said Mathew Draper, negro, his heirs and assigns all that certain piece and parcel of land Situated in Dover Hundred County and State aforesaid, lying on the west side of the new public road leading from Casson’s Corner to the new public road leading from Robert B. Wright’s residence to Pearsons Saw Mill adjoining lands of Jacob Corse, lands of Hugh D. Purris & other lands of the said Thomas Pearson, the same being part of a piece or parcel of land which the said Thomas Pearson purchased of Jackson Corse and wife on the 28th day of February A.D. 1865, as will appear by their Indenture of bargain and sale to the said Person now of record in the office of the Recorder of Deeds in and for Kent County at Dover in Book y. Vol 4 foolio 143, the metes and bounds, courses and distances whereof are as follows viz. Beginning at a corner in the forks of the said first above named road, with  the said road leading from Robert B. Wrights to Pearsons Saw-mill and in a line of land of the said Hugh D. Burns, and from thence running with a line of his land north twenty and three fourths degrees east forty Seven and two tenths perches to a stake at the side of clared land in a line of said Burns land and a corner of land of the said Thomas Pearson, thence running with a line of said Pearson South forty three degrees and forty minutes East fourteen and four tenths perches to a corner on the west side of the said new road leading from Casson’s corner to the aforesaid new public road leading from Robert B. Wrights residence to Pearsons Saw Mill a corner of land of the said Thomas Pearson’s in a line of land of Jackson Corse thence running with the west side of said new [road] and the said Corse’s line South thirty seven degrees and forty minutes west forty three and four tenths perches to the place of Beginning containing two acres of land be the same more or less.

And all and Singular the buildings, improvements, fixtures, ways, woods, waters, water courses, rights, liberties, privileges, hereditaments and appurtenances to the said hereby granted lands and premises belonging or in any wise appertaining and the reversion and reversions, remainder and remainders, rents, issues and profits thereof, and all the estate, right, title, interest, property, claim, demand, and possibility of them, the said Thomas Pearson and Rachel his wife at law or in equity, of, to, in, or, out of the same, and every part and parcel Thereof. To Have and To Hold the land and premises hereby bargained and sold, or intended to be, with the appurtenances, unto the said Matthew Draper, negro, his heirs and assigns, to and for the only proper use, benefit and behoof of him the said Matthew Draper, negro, his heirs and assigns forever. And the said Thomas Pearson and Rachel his wife for themselves, their and each of their heirs, executors and administrators, doth hereby further grant, covenant and agree, to and with the said Matthew Draper, negro, his heirs and assigns, that the land and premises hereby bargained and sol, or intended as to be, with the appurtenances, against them the said Thomas Pearson and Rachel his wife their and each of their heirs, executors, and administrators, and against all persons claiming, or law- fully to claim, by, through, from or under them, or any of them unto the said Matthew Draper negro, his heirs assigns, they the said Thomas Pearson and Rachel his wife shall and will Warrant and forever Defend.

$50.00 Received on the day of the date of the foregoing Indenture of Matthew Draper negro the sum of Fifty Dollars in full satisfaction of the consideration money for the therein granted landsand premises.

State of Delaware Kent County S.S. Be it Remembered, that on this Twelfth day of September in the year of our Lord one thousand eight hundred and Sixty five personally came before me George B. Dickson a Notary Public for the State of Delaware Thomas Pearson and Rachel his wife parties to this Indenture known to me personally to be such, and severally acknowledged this Indenture to be their Act and Deed respectively; and that the said Rachel Pearson being at the same time privately examined by me, apart from her husband, acknowledged that she executed the said Indenture willing without compulsion or threats, or fear other husband’s displeasure.
