This Indenture, made and executed this twenty second day of March in the year of our Lord one thousand Eight hundred and twenty eight by and Between Absalom Gibbs and Rebecca Gibbs his wife of Kent county in the State of Delaware of the one part, and the President Directors and company of the Farmer’s Bank of the State of Delaware of the other part Witnesseth that the Said Absalom Gibbs and Rebecca Gibbs his wife for and in Consideration of the Sum of Two hundred Dollars money of account of the united States to them in hand paid by the said president Directors and company before the Sealing and delivery of these presents (the receipt whereof is hereby acknowledged) have granted bargained and Sold released conveyed and Confirmed and by these presents do grant bargain and Sell release convey and confirm unto the Said President Directors and Company of the farmer’s band of the State of Delaware and their Successors all and Singular that lot of Land with the improvements and appurtenances Situate in camden and which the Said Absalom purchased of Daniel Mifflin as by the Deed of the Said Daniel Mifflin and debbe his wife bearing date the the tenth day of the Eighth month one thousand Seven hundred and Eighty Six which lot contains the quantity of one acre and one hundred and fifty three perches of land also all that lot of Land situate I Camden aforesaid containing two acres and forty nine Square perches with the improvements and appurtanances thereunto belong which the said Absalom purchased from Jonathan Hunn and Patience his wife by an indenture bearing date the fifth day of the fourth month Eighteen hundred and Seventeen reference thereunto being had will more fully and at length appear. also one other lot piece or parcel of Land in or near Camden aforesaid with the improvements and appurtenances thereunto belonging containing one acre more or less which the said Absalom purchased of Rhoda Williams and Charles Martin and Hester his wife as by their indenture bearing  date the fourteenth day of June Eighteen hundred and referene thereunto being had will more fully and at large appear, also a lot of ground in Camden afsd. With the improvements and appertenances thereunto belonging containing five acres and one hundred and four square perches which the Said Absalom purchased of Samuel Edmondson & Susannah his wife by Deed dated the twenty first day of Eighteen hundred and Seventeen, also one other lot of Land in or near Camden afsd. With the improvement and appertenances thereunto belonging which the Said Absalom purchased of John Taylor and Margaret his wife containing five acres and Seventy Square perches more or less, Deed dated seventh day of April 1817, also all that tract of Land which the said Absalom purchased from James and Susan Gilder administrators of Henry Gilder Decd. Containing seventy three acres more or less, with improvements and appurtenances thereunto belonging Deed dated 26th of February 1790 also all that Tract of land which the said Absalom purchased from Daniel Mifflin Decd Situate in Murderkill hundred with the appurtenances & improvements thereunto belonging containing one hundred & Sixty acres more or less, Together with the buildings and improvements inclosures woods waters branches and other advantages appurtenances to the Said lands and tenements belonging or in any wise appertaining: And the reversion and reversions remainder and remainders rents issues profits emoluments and Services thereof and of every part and parcel thereof: And also all the Estate right title interest property trust claim and demand whatsoever both in law and equity of them the Said Absalom Gibbs and Rebecca his wife of in and to the lands and tenements aforesaid hereby granted and conveyed and of in ad to every part and parcel thereof: To Have and To Hold all and Singular the lands tenements and premises aforesaid hereby granted and conveyed and every part and parcel thereof with the appurtenances to the Same belonging unto the Said President Directors and Company of the Farmer’s Bank of the State of Delaware and their successors to them their sole and proper use forever and to or for no other use intent or purpose whatsoever. Provided never theless, and it is hereby expressly agreed to be a condition to these presents, that if the Said Absalom Gibbs and Rebecca his wife their heirs executors administrators or assigns shall and will well and faithfully pay or cause to be paid unto the said President Directors and Company of the Farmer’s Bank of the State of Delaware their successors or assigns the just and full Sum of Two hundred Dollars…money as aforesaid together with the interest to grow due thereon and the costs and charges of making acknowledging and enrolling this present instrument of writing on or before the Twenty Second day of September in the year one thousand eight hundred and twenty eight then this present Indenture and every clause article and agreement therein contained Shall cease and determine and be utterly void and of no effect. And the Said Absalom Gibbs and Rebecca his wife for themselves their heirs Executors and administrators do hereby covenant grant and agree to and with the Said President Directors and Company of the Farmer’s Bank of the State of Delaware their Successors and assigns that in case the aforesaid Sum of money or any part thereof Shall be behind and remain unpaid at the time limited for the payment thereof, it shall and may be lawful for the said President Directors and Company of the Farmer’s Bank of the State of Delaware their Successors or assigns and they are hereby expressly authorized and empowered upon Ten days notice having been given by an advertisement set up in public view in each of four nearest hundred of the County where the said premises lie to expose to public sale the lands and tenements aforesaid with the appurtenances or so much thereof as shall be necessary and Sufficient for the payment of the aforesaid sum of money and the interest remaining due thereon: And also for the payment of the charges and expences of every kind attending and incurred  by the said Sale; and the lands and premises So exposed to Sale to bargain and Sell to the highest bidder for ready money or upon such credit as the said President Directors and company shall think proper and to grant and convey according to law and lands and premises with the appurtenances so to be sold to the purchaser or purchasers thereof for Such estate and interest therein as shall be sold by the and from the proceeds of Such Sale to pay the amount of Such Sum of money as Shall be due ad owing to them by the Said Absalom Gibbs and Rebeca his wife and shall remain unpaid as aforesaid together with all the interest due thereon and all the charges and expences aforesaid and the residue if any to be by them faithfully deposited in the Farmer’s Bank of the State of Delaware Subject to the order of the Said Absalom Gibbs his heirs executors administrators or assigns. In witness whereof the said Absalom Gibbs and Rebecca his wife ave hereunto set their hands and affixed their Seals the day and year first above written. State of Delaware Kent County Ss. Be it remembered that on this twenty second day of March in the year of our Lord one thousand eight hundred and twenty eight personally appeared before me Thomas Clayton Chief Justice of the Court of Common Pleas of the State of Delaware Absalom Gibbs and Rebecca his wife parties to the within Indenture and acknowledged the same to be their act and Deed and desired the Same to be recorded accordingly, And I further certify that the Said Rebecca being examined by me separate and apart from her said husband and out of his hearing she did acknowledge the within Indenture to be her act and Deed and that she became a party thereto and executed the same voluntarily and freely without being induced thereto by compulsion fear threats or ill usage by her said husband or fear o his displeasure.
