Deed Warner Mifflin & wife to Absalom Gibbs
This Indenture made this fifteenth day of June in the year of our Lord one thousand and eight hundred and twenty nine, Between Warner Mifflin of Murderkill Hundred Kent County and State of Delaware and Elizabeth his wife of the one part, and Absalom Gibbs of the hundred county and State aforesaid of the other part; whereas by virtue of a Deed of conveyance from William K Lockwood administrator of all and Singular the goods and chattels rights and credits which were of Samuel Mifflin late of Kent county aforesaid deceased to the Said Warner Mifflin he the said Warner Mifflin became Seized and possessed of a Certain piece or parcel of Land situate in Murderkill hundred aforesaid in the County aforesaid and Said to contain one hundred and fifteen acres more or less adjoining lands of Absalom Gibbs Batchelor Chance and others; and the Said Warner Mifflin and Elizabeth his wife are now by these presents about to convey unto the Said Absalom Gibbs all their right title and interest in the before described Land and premises for the Consideration herein after expressed.
Now this Indenture Witnesseth that the Said Warner Mifflin and Elizabeth his wife for and in consideration of a Deed of Conveyance from the Said Absalom Gibbs and Rebecca his wife to the Said Warner Mifflin for a certain piece or parcel of Land therein mentioned and of the Sum of one Dollar lawful money of the united States of America to them the Said Warner Mifflin and Elizabeth his wife will and truly paid by the Said Absalom Gibbs at or before the Sealing and delivery of these presents the receipt whereof they the Said Warner Mifflin and Elizabeth his wife do hereby acknowledge and thereof and therefrom do quit and discharge the Said Absalom Gibbs and his heirs and assigns forever, Have and each of them hath granted bargained and Sold given conveyed and confirmed and by these presents do and each of them doth grant bargain and Sell give convey and confirm unto the Said Absalom Gibbs his heirs and assigns forever, All that piece or parcel of land Situate in Murderkill hundred Kent County and State of Delaware said to contain one hundred and fifteen acres more or less adjoining lands of Absalom Gibbs Batchelor Chance and others so as aforesaid conveyed to the Said Warner Mifflin by the said William K Lockwood administrator of the Said Samuel Mifflin; and also all trees woods underwoods, ways watercourses profits commodoties advantages hereditaments And appurtenances whatsoever to the Said Land and premises belonging or in any wise appertaining or in any wife appertaining thereto and the reverse and Reversions Remainders and Remainder rents issues and profits of the Said premises and of every part and parcel thereof; and all the estate right title interest claim and demand whatsoever of them the Said Warner Mifflin and Elizabeth his wife of in and to the Said messuages lands and premises and every part and parcel thereof, and all the estate right title interest claim and demand whatsoever of them the Said Warner Mifflin and Elizabeth his wife of in and to the Said Lands and premises and of every part and parcel thereof with the appertenances to the only proper use and behoof of the Said Absalom Gibbs his heirs and assigns forever and to and for no other use intent or purpose whatsoever. In witness whereof the Said Warner Mifflin and Elizabeth his wife have hereunto respectively Set their hands and affixed their seals the day and year first herein written. State of Delaware Kent County Ss. Be it remembered that on the fifteenth day of June in the year of our Lord one Thousand eight hundred and twenty nine, before me the Subscriber one of the Justices of the Supreme Court of Said State Warner Mifflin and Elizabeth his wife named in this Indenture personally appeared and acknowledged said Indenture to be their act and Deed respectively and desired that it might be recorded as Such and that on the Same day the Said Elizabeth wife of the Said Warner Mifflin being privately examined by me apart from her Said husband acknowledged that she executed the Said Indenture willingly without compulsion or threats or fear of her husband’s displeasure Witness my hand the day and year aforesaid.
