Deed Absolom Gibbs from Rhoda Williams & Charles Martin & Wife 1813

This Indenture made the fourteenth day of Jun in the Year of our Lord one thousand Eight hundred and ___ Between Rhoda Williams a free Black woman widow of Beniah Williams a free Black man late of Kent County deceased and Charles Martin a free Black man and Hester his wife a free Black woman all of the village of Jarrell Town in Murderkill hundred Kent County and State of Delaware of the one part and Absalom Gibbs a free Black man (Bricklayer) in the hundred and County aforesaid of the other Part, Whereas the aforesaid Beniah Williams was in his life time and at his death seized and Possessed of a small Tract of land or part of a Tract of Land Situate in the village of Jarrell Town aforesaid and the aforesaid Beniah Williams died intestate leaving a widow the aforesaid Rhoda Williams by whom he left issue one daughter the aforesaid Hester wife of the aforesaid Charles Martin and treacle to the usages laws and Customs of the State aforesaid the aforesaid Rhoda Williams has a right of Dower or third Part of said deceased Real Estate during her natural life and the aforesaid Hester Martin wife of the aforesaid Charles Martin being his the aforesaid. Beniah Williams deceased only child and heir at Law and Whereas the said Rhoda Williams widow as aforesaid and the aforesaid Charles Martin Hester his wife are now about by these Presents to convey unto the aforesaid Absalom Gibbs one acres of the aforesaid Land which Acre of Land is situate lying and being on the East Side of dundee Branch and on the South Side of the Road leading from Said Village of Jarrell Town to the Village of Camden and Butted and bounded as follows vis. Beginning at the center of said road and at the East Side of the Run of Said Branch and Running with Said Road North Eighty nine degrees East Twenty Perches and South Eighty four degrees east Three perches to a corner in the middle of said Road for a dividing Corner between this and the Remainder of Said Land and running from thence for a division line South Eighteen and three quarter degrees West twenty three and an half Perches to the Run of Said Branch thence Running with Said Branch binding with the waters thereof and down the the Same about twenty eight perches to the Place of Beginning Containing and laid off for one acre of ground be the Same more or less now this Indenture witnessed that the said Rhoda Williams and the aforesaid Charles Martin and Hester his wife for and in Consideration of the Sum of Twenty six dollars and Eighteen and a half cents Lawful money of the united States of America to them in hand paid by the Said Absalom Gibbs the Receipt whereof is hereby acknowledged and themselves there with fully satisfied contented and paid hath Granted Bargained and Sold aliened enfeoffed conveyed and confirmed and by these presents doth grant Bargain and Sell alien enfeoff Convey and Confirm unto the Said Absalom Gibbs his heirs and assigns forever all the above Described acre of Land with its appurtenances Situate in the Village of Jarrell Town as aforesaid in Murderkill Hundred Kent County and State of Delaware Together with all and singular the houses Buildings Gardens Meadows Swamps Cripples ways waters and water courses fences pasters improvements timber and Trees Rights titles Rents Profits hereditaments and appurtenances whatsoever thereunto belonging or in any wise appertaining and the Reversion and Reversions Remainder and Remainders Rents issues and profits thereof To have and To hold the Said one acre of ground and premises hereby granted unto the said Absalom Gibbs his heirs and assigns to the only proper use and behoof of him the said Absalom his heirs and assigns forever the Said Rhoda Williams and the Said Charles Martin and Hester his wife and their heirs the said one acre of Land and Premises hereby granted to the said Absalom Gibbs his Heirs and assigns against themselves the Said Rhoda Williams and Charles Martin and Hester his wife and against all and every other person or persons whatsoever lawfully claiming or to claim any parcel or part thereof by from or under them Shall and will warrant and forever by these presents defend. Kent County State of Delaware ss } Be it Remembered that on this twenty fourth day of June in the year of our Lord one thousand eight hundred and thirteen Rhoda Williams Charles Martin and Hester his wife the grantors in the foregoing Indenture named Personally Came before me William Warner one of the Justice of the court of Common Pleas for the State of Delaware aforesaid and Acknowledged the Same to be their act and Deed Respectively and desired that it might be Recorded as such.
